If a person receives the visa packet between December 2012 - January 2013, will they still pay $165?

Sounds to me like the person would need to enter the US by 1-31-13 to avoid paying the fee.

Sounds to me like the person would need to enter the US by 1-31-13 to avoid paying the fee.

This is what I understood as well since this is basically charging you the CBP officers time in opening the package and processing it. As well as the issuing of the Green Card which all happen upon entry to the US.

Oh well, I also was one of those who thought it would cost $404, so I guess this balances that out.

I understood that if you received your visa packet from the embassy after 1-31-13, you would pay the fee. From the uscis site:

"Any individual who on or after February 1, 2013 receives an immigrant visa package from a United States consulate or embassy abroad (including Canada and Mexico) will pay the USCIS Immigrant Fee."

So actually POE date doesn't affect whether you pay the fee, visa approval/handover of your visa and packet is what determines whether you'll pay. Right? Or am i totally misunderstanding this?

This is correct. At least you are understanding their grammar correctly. They stated that the fee is for visa's received on or after Feb 1, 2013. Doesn't appear to matter when you enter (though you must enter within 6 months of receiving an immigrant visa).

Would I have to pay this fee??? NVC have received my case, got my medical on the 21st, sending in all my paperwork to hopefully get an interview at the end of January to be in the states ready for my fiances homecoming from Afghan in March. I need to give one months notice at work (feb) so I wont be entering the US (if all goes to plan) till the beginning of March...

If so does this mean I have to pay for the visa, the courier at the embassy and now this?? CONFUSED :blink:

Base on the info, it's applicable to immigrant visas. K1 is not considered an immigrant visa.

So I may actually (fingers crossed) get my wifes visa approved on the 30th, and not have to pay the new fee. We will see, sucks to lose out on $165 cause of a couple of days.
