Well I have my 2 years conditional GC, my husband and I are separated months ago after being married for almost a year..and I am meeting with a lawyer tomorrow to do the separation agreement since in this state you have to be separate for a year before filling for divorce.

I am planning on starting school next semester and all the money i make a month will go there. But I am scared to start school and in 2 years when I file for the 10 years gc it gets denied and i will be ordered to leave the country and It would be 2 years that i wasted my money and time on school if I have to leave.

I met and dated my husband for a year when i was here with a J-1 visa and then I went back to my country and I applied for a K-1 visa. Came here with the K-1 visa. Was married for almost a year and I have proof of marring him in good faith. I also have a domestic violence report and proof of him cheating on me... But he told me the other day that he went to uscis and told them I am married him for a gc and I don't know what else he told them..

I really want to know if my gc of 10 years doesn't get approved. Can I get a student visa? or another kind of visa?

01-20-2012- AOS package sent

01-23-2012- AOS package received by USCIS

01-27-2012- NOA1 (email)

02-01-2012- NOA 1 (Hard-Copy Received)

02-07-2012- Biometrics Appointment Notice Received

02-13-2012- Email saying case was transferred to another office(Waiting for the hard copy to see where it was sent)

02-17-2012- Hard-Copy received- AOS transferred to CSC

02-21-2012- Biometrics Appointment-

03-13-2012- Biometrics Retaken due to they didn't take right my fingerprints.

First, relax. The USCIS will only accept his claim with PROOF. Second, you can file for your 10-year GC after the divorce is finalized or within the 90 day window of your 2-year GC expiring, which ever comes first. Just file the ROC with a waiver for filing jointly and supply all proof that you entered the marriage in good faith and now you are divorced.

Don't worry about it.

Once your divorce is final you need to file ROC, or when the window opens, whichever comes first.
