My wife came in with a K-1 visa, we got married, and two weeks later we went to the SSO to apply for a ssn as everything I read said it was best to wait till after marriage because of the name change etc. However, the agent told us that we could not apply because since we had gotten married, and that caused the I-94 to expire. She basically told us that if we applied with the "expired" I-94, and she put the name in as her new name that the system would reject it. I was not aware that the I-94 would expire upon marriage. Now I can understand the K-1 part. I have been looking for something that would say either way, but haven't been able to find anything. My wife's I-94 still has over 60 left on it. Could it be because we went to a really small branch (only 1 agent window), and she was just not sure on the procedure, or was she correct and we did it wrong?

That doesn't make any sense. If there's another SSA office in your area, go to that one. Also, be sure to print out the "RM 10211.530 List of Documents Establishing Lawful Alien Status for an SSN Card" just in case you get someone else who has no idea.

It sounds like the SS office worker is in error. :bonk: Go to another office. Your wife's I-94 information may not yet be in the CBP SAVE database, but you should be able to apply. Take a look at the forum's step-by-step guide on obtaining a SSN:

Two options. 1) send an e-mail explaining what happened to you to the main SSA website. They have been giving out e-mails to educate their local offices on the proper procedures when dealing with the K-1 visa. 2) go back to the local SSA office and apply in the maiden name. Make no mention of the marriage and get the SSN that way. Then change the name to the married name at a later date. Yes, that is a PITA and is not necessary according to the SSA, but it does get around the idiot SSA employee.

The I-94 has an expiration date written on it and that is when it expires. IT does not have any wording that says it expires upon marriage because the I-94 form is given to all non-immigrants, and K-1 Visa holders, that enter the US. The best way to deal with this person is to tell them that they work for the SSA and not USCIS and they do not know what they are talking about.

Lazy, wrongly informed SSA employee. Go to different office or email them through their webpage. Print the reply out once you get it and bring it to the SSA.

Marriage has nothing to do with the I94. Even after the 90 days, marriage won't magically do anything to the I94 or the 90 days. However, it's extra footwork for the SSA employee to match the maiden name in their database up with the married name on the marriage cert.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days
