Hello,

I have a quick question. I am filling the Affidavit of Support for my AOS. My husband works part time and I work as a nanny to help him. I don't have work permit, which I know it is illegal but I just needed to get a job. Anyway, when I file for Affidavit of Support, my husband's income combined with mine is above the 125% poverty line. My question is, even though I've been working without EAD, can I put my income as part of our household income for my support as an immigrant? Can I ask my employer to write a letter stating my income?

Are you serious? If it is illegal for you to work how are you going to show income? I sure wouldn't be going that route!!

05 DEC 2012: NOA's I-765, I-131, I-485

14 DEC 2012: Biometrics appointment finished(Walk-in..Was scheduled Jan 04 2013)

02 FEB 2013: I-131 and I-765 Approved

07 FEB 2013: USPS Picked up the combo-card

11 FEB 2013: Received Combo-card

21 FEB 2013: Transit Visa picked up in Chicago for Japan

First thing first - good that you added the job on the #325A(I think that's the one asking for it). USCIS will find out one way or the other and you don't want to get caught in a lie.

Here's the good news/bad news;

Working without EAD is usually forgiven when being the spouse of a US citizen. No worries there.

You cannot use your income and combine it because you aren't authorized to work. ALso, make darn sure that you didn't claim to be a US citizen on any forms you might've filled out. Third thing - are you paying taxes?

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Thank you so much for your reply!! I have never claimed to be a US citizen, I know I am not!

And yes, my employer is taking taxes from my pay check weekly!

Should I quit until I get my EAD?

You did work already. I don't think it'll make any difference now other than making your life worse by getting less income.

As said above, anyway its forgiven in marriage based AOS. :yes:

Day16 - 10/12/2012 - Biometrics Walk In - Refused

Day20 - 10/16/2012 - Biometrics Walk In - Successful :)

Day33 - 10/29/2012 - EAD card Production Ordered-Pleasant surprise :)

Day37 - 11/02/2012 - EAD Card received - WoW !

Day40 - 11/05/2012 - Interview letter for Dec 4 date - The BIG Day !

Day70 - 12/04/2012 - Interview done. Pray to GOD!

Day95 - 12/28/2012 - Letter for 2nd Interview in Feb
