Hey so I'm in the process of the k-1 fiance visa currently waitin for noa2.

I realize I have to meet 125% of the federal poverty guidelines to sponsor my fiance. I got hired as a server today and my question is do the tips I report count as normal income to determine if I meet the 125% of the federal poverty guidelines?

I don't know if that's the correct place to ask. Hope anyone can help!!

I think tips count as long as you can prove that you are receiving them AND as long as you report them on your taxes at the end of the year.

Yes they do, I brought my fiance here using my income as a server. You are most likely required to report your tips at the end of the shift. Make sure you report enough to meet the requirements. Remember you are required to report 100% of your tips but no one goes in your pocket to count what you made.

Your income is determined by your consulate. You need to look at the guidelines from the embassy your beneficiary will have their interview. Normally, I would say yes this can be included if it is reported, filed on your taxes and included in your W-2, but if your consulate says No, then you will need a co-sponsor.
