I-130 question regarding bonafide and paperwork

Hi all I just had a few questions.

1.) My wife's parents died when she was a toddler. Her aunt and uncle adopted her and raised her. On the 1-130 I put her aunt and uncle as her parents. Was this a mistake? I have a copy of her birth certificate along with the adoption papers. Will I be okay or will the USCIS raise a fuss since the BC has her real parents and the packet had her adopted parents.

2.) I submitted pictures, phonelogs, text logs, 401k beneficiary add, and life insurance beneficiary change for bonafide relationship. Should I transfer some money via western union to show monetary connection also? The banks won't let me add her as a joint member since she's not a USC. Is what I submitted enough for bonafide in the initial stage?

You don't put her parents' names on the I-130. You don't even put her parents' names on the G-325A. You put her mother's name and father's name (whether they are alive or dead, they mean biological). Your birth certificate will confirm who her mother or father are.

Her most recent legal guardians would be a different story. They aren't asking for most recent legal guardians, though. Mother and father are titles of biological parents. I would think that as long as you sent a copy of her birth certificate and adoption papers, you would cover your bases.

But they still might be able to figure it out. You may not get an RFE. If you do, it'll be easy to fix.

This should be enough to establish a bonafide relationship. Good luck!!

I'll just wait an see. I actually wrote in her uncle and aunt's name in the parent's field on the G-325A. When/If I get the RFE, I have the documents needed for clarification. I'll type up a story also in case they need to be spoonfed.

Thanks alot for #2. That one had me worried.

There is no "parents' field." there is a mother field and a father field. But USCIS will figure it all out if you've already sent it in. And yes, if they RFE you, there's nothing to fear. It's a simple error that's probably made often, and can be fixed easily. :)

It doesn't state "biological" mother and father. It jut says mother and father and seeing as her parents died when she was a toddler she probably views them as her mother and father. I would think you need to provide copy of the adoption papers or you're most definitely going to get an rfe of some kind. I don't think what you did was incorrect at all.
