My husband and I were planning on getting married, but hadn't figured out if we wanted to do it in England, where he is from, or here. Well, he came over on a VWP and was just planning a visit, while we worked out what we wanted to do,and we had been going over all of the K-1 papers and what we would need to do, etc. Well, Spur of the moment, we decided to get married, essentially eloped, did a nice courthouse wedding. So, question is, because we had been talking about the K-1, even though we hadn't decided on it, since we weren't sure if we were marrying here or there, does that end up with it looking like we had intent to marry when he came back? I am so confused. It's a good thing he is worth it.

It might look that way. But I think this happens all of the time. As long as he told them truth that it was original intention to just visit, then it won't make a difference. You don't need a visa to get married while visiting. I was up front with immigration when I went to Florida to marry my wife. I told them flat out, I'm getting married in Florida and am returning. They were cool with that. If he wants to stay, you should submit an I-130, and then adjust his status.

Congratulations and :guides: for seeing how he can just stay and adjust status. If money is tight and you think it's best for him to go home and wait, that's fine, too. Still submit the I-130 so that you can get that out of the way. The I-130 takes the longest out of the whole immigration process (assuming no Administrative Processing after approval).

I don't think you'll have any issues at all with adjusting status in the US now that you're married. I'm from England and came to visit on the VWP in May and we got married before I was supposed to leave so we sent all the paperwork in and I was approved the other week with my Green Card on the way.

I followed this guide: Adjusting from VWP and asked questions when I wasn't sure of something. Some will tell you that you shouldn't do it, or that you'll be viewed negatively for doing it. Not true in 99.9% of cases. Some people just have issues with other people having access to visa-free travel.

As someone mentioned above, follow the guides on here for adjusting status. You can file the I-130 along with the I-485, do not send them separately. Additionally, go onto the USCIS website and search for the list of approved Civil Surgeons in your area. Your husband will need to complete a physical before you send in your application. We're in the same boat as you guys, filed our paperwork at the end of Sept. Message me is you have any questions! Good luck and congrats :)

With the physical, he has Borderline Personality Disorder. He was on a form of disability there for it, kind of like SSI here, from what I understand. Will that affect things? Negatively?

Well if it's going to affect him at all, it would affect him positively.

You know, it really doesn't matter. It might affect the Dr report, or it might not. It all depends on how bad this disorder is. In some cases if he is a danger to himself or others, then the Dr might fail him. But as long as he is under the care of a Dr and is healthy and hasn't caused harm to anyone (including himself) I don't see them denying him because of this. But in the end, you just have to take the chance to be happy. If they don't like his condition, there's nothing that can be done about it. I don't think they'll care about that, though. Again, as long as he isn't violent and a danger, they probably won't care.
