I'm currently still working on getting my K-1, but once I do receive my green card and am in the US, I have a question about how this could work.

My husband may have a job offer with a US based company to go work for them on a deal in Kuwait. He's move there for 18 months.

How would I go about being able to go with him? Can I do that when living in the US on a Green Card??

Thanks!!

Heather

Yes once you have green card you could go with him. Since the time is more than a year outside the country, you will have to apply for a reentry permit. File form I-131, same form and fee that is for AP.

18 months might be a bit of a long time.... isnt there a thingy (when i cant think of the word this is a substitute - someone more enlightened might get what im thinking) - where you have to stay in the states for a certain amount of time to retain residency?

As a general rule, if a LPR leaves the U.S. for one year or less, he/she can use the green card as a reentry document. By contrast, when an alien is absent from the U.S. for more than one year, he/she may have a difficult time reentering the country because the USCIS takes the position that an absence of longer than one year in duration indicates a possible abandonment of U.S. residency. For those LPR’s who have been out of the U.S. for more than one year, they will need to obtain reentry permits or special immigrant visas

google on further (especially in the uscis. site) and you'll find that there are exceptions listed for LPRs who go abroad because of their USC spouse's job, especially when it's for certain US orgnaizations/companies.

It's not a black and white issue.

There is a residency requirement of not being out of the country for periods of more than 6 months during the 3 or 5 year resident time to naturalize. You may be thinking of the residency requirement to become a naturalized citizen.
