They Generally ask for Birth Certificates to confirm the True Identity of the Beneficiary.

Please refer to the I-130 and the I-130 instructions and point that out to me?

Cause I'd hate to learn that I missed it.

I am so sorry about dat. Please take heart, i truly understand how u feel. Do not

give up yet untill u have received the letter u said they sent in the mail. It maybe something u can work out. I would also advise that u and your spouse be very very prayerful. God turns situation around, he has not disappointed me thru the stages of this processing, its been tough but if u hold unto Him in prayers, He will make all things work together for your good. It is well with u. God bless u.

You don't need to worry or cry about the notice the USCIS are so crazy frustrating petitioners, that notice may even be asking you to submit what you've sent to them before. There are crazy adjudicators there at the USCIS. Waiting untilu get the letter follow the instructions and will also advice you to contact your district US Congressman/woman for genuiness of your case. I did that and it worked. Let me know how far it goes we will get your petition approved at by all means. GOOD LUCK.

We also got a Notice of Intent to Deny from a field office. All that was "missing" was my (beneficiary) Birth Certificate. We had 30 days to send it in. Rather than make a fuss because it's not supposed to be required at this point we just got it sent.

Yours could also be something this simple.

Now I am worried that my application will be delayed because I didn't include my spouse's (beneficiary) birth certificate? I also didn't remember this was needed? Anyone with reassurances and comments on this?

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

we all know how you feel right now and please don't give up ,this journey is not an easy journey and we all should be prepared for any outcome and be ready to fight for the one we love , i will pray for you and i am sure as other vj members are saying it could be just a simple thing so don't panic please :) we all with you my friend :goofy:

I'm so so sorry but like others have already said there could still be hope. I currently found I was approved or reaffirmed on the USCIS site but after several calls I am told that could be an error and I am still be pending with the USCIS. The information on the site have not changed yet and I have not received a letter yet. The information online or the phone is not always complete or accurate. I know it's hard but hope for the best and try to think of what you could have missed and start preparing. Don't give up.....

July of 2010: We met in Eritrean when I was on vacation.

August of 2010: Returned to U.S and we spoke on the phone everyday and still do (very costly).

December of 2010 to January 2011: went back to Eritrea to see him.

January 11, 2011- Engaged.

March 2, 2011: I-129F sent

March 13, 2012: Second interview. Placed on Administrative Processing.

October 16, 2012: Case sent back to USCIS

November 16, 2012 Case reaffirmed and sent back to the Department of State (according to the USCIS SITE)

November 28, 2012 Vermont Service Center received Petition back from Embassy.

March 2013- Returned K1 validity expired. Here we go again.... !

I-130

March 15, 2013 Married

April 29, 2013 Filed I-130

May 2, 2013: Received NOA1 via text/email

May 6, 2013: Received NOA1 hardcopy in mail

XX- XX, 2013: Received NOA2 via text/email!!!

XX- XX, 2013: Received NOA2 hardcopy in mail

XX- X, 2013: NVC received file

XX- X, 2013: NVC case number assigned

Thanks all for your input. The letter came yesterday. Basically it's all falling back on the I-129f that was returned to the USCIS and the comments that the consular made regarding my husband.Definitely show she did not listen to him as her statements are inaccurate! Especially her remarks about our religion.

Looks like we have to start from the beginning of our relationship right up to today.

I am so stressed and so is my dear husband. What an uphill battle we have. But all things are possible with God.

The I-129f case # is not mentioned in the letter. Our I-130 case number is all over the letter. Tommorrow conferring with an immigration lawyer to get some direction as to what more to send in to USCIS and how to best organize it. At least today my nerves have calmed down some. Spending time now gathering all the stuff that I sent for the I-129f and the I-130. Unfortunately I am not the most organized of petitioners so am scrambling to make sure I have all in order. :innocent:
