what is driving me nutts is WHY DO THEY WRITE SOMETHING ON THE WEBSITE AND THEY DO STH TOTALLY OPPOSITE TO IT? "Can i have my spouse in the US while she has a pending request?" SPOUSE: means WIFE..and why do they advise stuff that would destroy and delay!!!!

The K3 still appears on the USCIS website as a viable option because the provision in the LIFE Act that created the visa in the first place has never been repealed. Therefore, the K3 officially remains on the books even though it is obsolete in practice. Additionally, administrative closure of the K3 occurs at the NVC, a State Department agency, USCIS is not involved in State Department policy and planning.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

actually it did not cost us more money.. it is like dependent on the IR1/CR1 so we did not pay anything more.. the idea is not with paying more.. the idea is with the fuss it made! they have to be more precise and accurate and explain everything not just throw words without explaining anything or explaining it in a way that people understand and they mean sth else!

Your husband can put in a service request and he can also call the USCIS and talk to an ISO (tier 2 human) vs the first person who answers the phone who is a CSR and cannot help him the way he needs to be helped. He needs to dig a little deeper. I think they are working on cases around your timeline right now so you may receive something this month but it doesn't hurt for your husband to call and ask. 06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

on the USCIS website in the spouse section; there is sth written below: Can i have my spouse in the US while she has a pending request?.. the answer was yes by doing the I-129 K3/K4 visa type while you are already doing her the IR1/CR1.. and when he called the USCIS an agent told him the same so he did it.. we noticed a delay in our case and whenever we call anybody he just says next week and next week.. so few days ago he's been to the Immigration office in Cincinnati and they told him that everything was smooth until you applied for the fiance'e visa (I-129) on September.. my husband told them that he did not do it cz he wanted to, he was trying to get me to the states faster and an agent at the USCIS has advised him to do that.. so the guy at Cincinnati told him that they are trying to consolidate 2 files under one name and that everything is going good and he thinks it won't take too long and that if he hadn't done this move i would have been with him in the states now and that he should write a letter to explain his case to VSC..

You have an I-129F in play, with a receipt notice in September?

Yes? No?

If Yes, then your calendar is shifted back to September - forget about anything occuring in May 2012 with the I-130 submittal,

as

When an I-129F is submitted, the I-130 is yanked out of it's place in the queue, joined up with the I-129F,

and

the two casefiles now have a place in the queue based on the date the I-129F was submitted.

So, IMO, you're going to wait 6 months from the I-129F receipt date, not 6 months from the I-130 receipt date.

A nice caveat MIGHT be - the I-130 was pulled to join with the I-129F in September, and all was sent to MSC.

So, call USCIS, get an ISO (see ISO - http://www.dhs.gov/files/publications/gc_1305658440339.shtm ) and ask what's up.

(The USCitizen Petitioner must call, inquire)

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Alas, USCIS thinks a K-3 is a viable visa, where NVC thinks it's NOT a viable visa.

my husband has been to the immigration office in cincinnati and the guy told him that the I-129 application made the delay and that it's been 2 months for them cosolidating files and our goal was to speed up the process as it is said in the USCIS website at the spouse section...: you can have your SPOUSE in the states if she has a pending request.. so the officer asked him to send a letter to VSC so as to explain the misunderstanding and he told him that they are almost done and everything is ok and that it should not take too long.

That officer, on that one part, was clueless.

Please remember, 5 years ago, this 'get here faster' thing was a viable option.

Today, it's not. Indeed, filing an I-129F after filing an I-130 delays the casefile processing at USCIS - something you have learned firsthand, recently .

our case closed at the nvc november 6th and our interview is jan. 22 we went through vermont..jordan has a very large capacity right now they also process visas for Iraq...
