Sadly I did the same thing. I had to wait a month and a half for them to contact me, telling me that I did not include necessary forms (which I had realized about 2 days after I had sent the 129 in! - but everyone I spoke to insisted I wait for contact rather than send the background info and the photos in...) So...you will be sent a decline notice telling you that you did not submit the necessary forms. Since you do not have a computer at the moment, either go to a computer lab where you can download and print the 325a forms, which are the background info forms - one for you, one for your fiance. You could also call them and they will send the info out to you...But again, you need to wait to send it back in until they decline your petition. You will file an appeal to get it reopened and send the 325A forms with a passport style photo of yourself and of your fiance.

It's such a drag, I'm sorry you have to go through this as well. It takes so long and is so frustrating. Good luck and be patient!

I just called them, they said they will just sent for the missing info,, and I just checked they did cashed the money order\

With whom did you speak? Unfortunately, the tier 1 level of the USCIS help line isn't the most helpful or reliable. There have been many instances of people hearing similar comments from them, particularly in cases where the petitioner only sent the I-129F and payment with no supporting documentation. There have been some threads where the petitioner received an RFE for the remaining information, but you should prepare for a denial, which may not come for some months. Either way, read the VJ guides and start gathering the supporting documentation: http://www.visajourney.com/forums/index.php?autocom=custom&page=k1guide

Part One: The K-1 Visa Journey:

USCIS Receipt of I-129F: January 24, 2012 | Petition Approval: June 15, 2012 (No RFEs)
Interview: October 24, 2012 - Review | Visa Delivered: October 31, 2012

Part Two: Entry and Adjusting Status:

POE: November 18, 2012 (at SFO) - Review
Wedding: December 1, 2012 | Social Security: New cards received on December 7, 2012.
AOS Package (I-485/I-765/I-131) NOA1: February 19, 2013 | Biometrics Appt.: March 18, 2013
AP/EAD Approved: April 29, 2013 | Card Received: May 6, 2013 | AOS Interview Appt.: May 16, 2013 - Approved Review Card Received: May 24, 2013

Yoiur petition is going to be denied since you did not include enough inforamtion to establish a petitionable relationship. Best thing for you to do now is send a NEW petition with NEW payment (YES, you lose your money) and a letter explaining your mistake and withdrawing the first petition. BUT read the instructions and guides here first and attach all the necessary forms and documents.

IF the ONLY thing you sent was the I-129f you will NOT get an RFE for "everything", you will simply be denied. You can wait 6 months for that to happen or you can cut your loss now, send a new petition and withdraw the old one.

I'm assuming I will have to pay an another 340 dollars again...It is better to go with the appeal or filed all over again, and did they sent you a receipt number?

@penguin.. I sent it in december 3rd and I didn't check yet on the money order

--- if you wait for the appeal process you will not have to pay more money, just have to wait a good month or two. or as someone else stated you can resubmit your forms completely and pay the $340 again...since you just sent it a few days ago maybe you can cancel the check/money order and resend the forms completed...not sure?

Moving from Progress Reports to Process & Procedures.

**Organizer hat off**

Since you only sent the forms and fee, I am going to suggest that you try to send the remainder of the required documentation along with a copy of your NOA1 (once you receive your NOA1). I usually say this is an exercise in futility because such submissions are unlikely to get matched with the file. However, if you wait, you may be waiting for a denial notice because improper submission of a petition can be (and often is) denied outright. By sending the required information now, you are at least trying to give this current petition a chance. Be advised that it the documentation you send now may now get matched with the file and the petition can still be denied.

I received the notice of action today stating that they received it.. Should I call again or just wait for the denial letter

:(

Calling won't do you any good. Follow what Gary wrote -- withdraw the current petition. While doing that, get a new I-129 petition package together following the VJ guide. Don't wait 7-8 months just to get a denial when you could have done something about it. And an appeal is pointless since you didn't follow the instructions. It would take just as long. You're better off spending the time restarting now. YMMV
