So my husband and I are both living in Korea, and as such, we do not have a US income to show that I can support him. My dad is going to sponsor him but I'm confused on a few important parts!

1. Does only my dad fill out the affadavit of support, or do I ALSO fill one out to show my lack of income?

2. Does his income only need to cover my husband, or is he supporting BOTH of us?

Thanks so much! We hope to schedule our interview in Seoul soon! :)

1. you fill one out, yer father fills one out.

2. just your hus-band.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yep- add a short, one paragraph letter with your original signature explaining why you were not required to file taxes.

thanks! lovin' the speedy reply! as for 1. I don't have any tax papers from the last few years [Peace Corps straight to working in Korea] so I guess I just fill it out without them?

I gave an explanation about taxes in your previous thread on this same subject. Did you see that? It's kind of important to know if you were required to file or didn't because you thought being out of the country was a valid reason.

P.S. If you filed your US taxes to reflect your Korean teaching income, there's a good chance Seoul will take it. We had an interview at Seoul a couple weeks ago. We're a family of 3 and my teaching income in Korea was just enough to meet the guideline for the last year (although in prior years I didn't earn enough). I had brought a joint sponsor packet but they didn't even look at it. They just glanced at my I-864 and took that, handed back my joint sponsor packet. It's best to be prepared with the full joint sponsor I-864, but if you get all your own info and taxes lined up, you may walk out of the interview without having needed the other I-864. I don't like committing other people if I don't have to, so getting to use my own income was great.

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

CRBA filed 1-3-13 at Seoul for our daughter
