If you think he might have filed, I highly suggest you visit your country courthouse (or which ever one holds jurisdiction) and pay a visit to the Clerk. Ask if there are any files in the system under your name.

She said he "filed" but that she hasn't been served but I don't know if she's meaning that he went to a lawyer and had the papers drawn but not filed, or if she means he actually had them filed with the court.

It is most DEFINITELY in her best interest to find out whether there is a divorce case in her name, and whether he has claimed he has tried to effect service. All manner of weirdness could be going on. You can look up a lot of states court records for free online. You can't see a lot of details, but you can usually see names and what part of the process it's at. If you can't find your states site it won't hurt anything to go ask the clerk to look and see if there's anything in your name.

Divorces with children are totally different then ones w/o kids. The parents are required to go to parenting classes, and the child (based on its age) is required to attend a workshop on how to deal with the divorce.

For your county, its saying it will take a mandatory 6 months to be finalized.

As for the 864. The 864 was a contract your husband signed promising to provide you with support to keep you above the poverty level for 10 years after your GC was issued. However in MI you wont be allowed to receive state benefits until you have been a LPR for 5 years. So it seems like you may have to wait another year before youre able to apply and hopefully things may be better in a year and you wont need to.

But for right now you CAN go down and apply for benefits for your child who is a USC. If your income is low enough they will give you food/cash/medical/daycare assistance for your child.
