Hello dear VJ members,

There is something bothering me and I would like you all to please help me resolve it, when we wanted to submit our petition, we thought we will be moving through the K3 line and when we read the details about K3, sending first I 130 and then after NOA1 then we will send out the I 129F, this is what we thought of doing before and when we sent our petition, we sent all the required evidence, but we put copy of my last three years IRS tax there and also fill form i 134 and put it there altogether, after submitting it , we learnt that K3 is no more functioning, so we had to rely on our i 130 petition, and my concern now is that sending together IRS tax and I 134 with our documents at the USCIS stage, won't these things damage our petition by making them to deny us ? we know now that for CR 1 petition we will need I 184 and not I 134 which we will do if approved at the NVC stage

Why would they deny you for sending in another petition and extra paperwork? They'll probably just ignore the extra paperwork, tie in the i-129f to your i-130 and approve both at the same time, which means that when it's sent to NVC you'll go through the CR1 path instead of the K3 path.

On your timeline you put your service center as Vermont, are you sure about that? What does your number start with? Could you post the text of your NOA1? The reason I'm asking is that most who applied i-130 were sent to the National Benefit Center in Missouri and if you were sent there, you need to update that on your timeline.

thank you so much , my husband thought so also. now i am fine now. When we sent our petition on sep 11th , we sent it to USCIS chicago locker box because I live in Georgia and on 13th of september , i received an email from USCIS sayingYour case has been accepted and routed to the USCIS Vermont Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number EAC---------. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.<br style="line-height: 17px; "><br style="line-height: 17px; ">This confirmation provides notification of the date USCIS received your case. This notice does NOT grant any immigration status or benefit. You MAY NOT present this notice as evidence that you have been granted any immigration status or benefit. Further, this notice does NOT constitute evidence that your case remains pending with USCIS. The current status of your case must be verified with USCIS.<br style="line-height: 17px; "><br style="line-height: 17px; ">PLEASE DO NOT REPLY TO THIS MESSAGE

And on the 19th of September , I received a hard copy of the NOA1 in the mail , when says The I 130 Petition for Alien Relatives has been received by our office for the following beneficiaries and is in process. they quote my husband name and his date of birth and country.

On the September 17th, USCIS sent us another notice, they said form i-797 c notice of action, the receipt number is there, receipt date which is 12th September , petitioner name , beneficiary name and they said notice type : transfer notice. they said this is to notify you that we have transferred the above application or petition to the USCIS office at USCIS -NBC, P.O.BOX 648005, Lee's Summit, Mo 64064.We transferred this case because the record indicates that office has jurisdiction over the case , that office will notify you of subsequent action taken on this case

does this mean that my petition is with the NBC ?

Yes that means you were transferred to the service center in Missouri.

No worries about denial. You just sent them what you will have to send them when you get to NVC. Just have all your I-864 at the ready. More than likely you will get your NOA2 soon. NBC has been approving pretty fast. So rest your mind. It is well.

thank you so much for your reply. but i have one question my receipt number start with EAC and i thought that is Vermont . though they sent me a hard copy saying it was transferred but i read on this and they said people in NBC , there receipt start with WAC I want to change my timeline now and it states EAC for vermont and WAC for NBC, do i need to choose NBC despite having an EAC receipt number ?

Yes, choose NBC anyway. People were first accepted in Vermont and California service centers which is why their numbers start with the letters for that service center, but your transfer notice means that you're definitely transferred to NBC. They don't change the receipt number once the file has been transferred to NBC.

Never, ever.

eh - you are awaiting on approval at the NVC stage before sending in the I-864? OK, I guess that's always a personal choice, but I would suggest to you that you've got it backwards.

Yes they are not required at the USCIS state and we have made mistake by sending it together and we thought we might have problem but they said it wont affect our petition. and also about the CR-1, what i meant was now we know that once we get approved at the USCIS stage and we are in the NVC stage, we know now that it is I 1864 we are going to fill and send and not I 134 . thats what i was trying to say
