Hi All Happy Holidays ,

MY friends are all confused . The wife is a US citizen now she petitioned her spouse he is from Peru they reside in Dc . They filed the I-765 and I-485 together got receipts back in October he has gone for his biometrics weeks back. They can see the case status online as USCIS system has an error says case cannot be found they called an agent weeks back was nice guy he said all looked to be okay . They went online yesterday and the system months later is still not showing their case status at all says case can not be found when the enter the case no for the I-130 which was approved :dance: it shows as approved . SO as I was visiting them we decided to call USCIS again .WE called first agent we got said he could not see the case info also and transferred us to another department the Agent was not too friendly at all .We confirmed who we were etc and they gave permission for me to talk on their behalf .The agent said "Oh it will take 6 months for the EAD " I know each case is different but looking at a lot of the timelines here people seem to have gotten the EAD in like 3 months they are in Dc . I know we have the holiday upon us now and days where USCIS staff will be off but six months . The husband and wife have submitted the Affidavit of Support also. They have a lawyer on the case but he just says the same wait its all a waiting game . The husband entered the US legally on a tourist Visa and obviously out stayed his Visa .He has a clean record never being in trouble or anything like that. So any shared stories much appreciated.Also when will USCIS get that online system up and running correctly its being like this since early October . I know I may have asked similar question before but now I am a bit confussed also alot of the timelines I read here seem to have went through the process pretty fast .. :yes: :yes:

I replied to your private message. I know your friend is not seeking a Tourist Visa. You said that your friend came into the country on a Tourist visa, got married and stayed. This means that he will Adjust Status from being a Tourist to LPR because he married an American Citizen.

The other forum is for those of us who are AOSing from FAMILY BASED VISAS.

This is the correct forum for this topic.

Without seeing a timeline it's hard to give information to you. The current processing time for EAD is 90 days. Current processing time for AOS/i485 is 6 months. A lot of cases do not make it into the online system, it's unlucky but normal. When did your friend file his/her applications?? When did he/she complete biometrics?

Husband's AOS Journey from VWP Entry

6/22/2012 Boyfriend entered US under VWP

9/15/2012 We got married!

9/21/2012 Stamp on passport expired

9/28/2012 Mailed I-130 & I-485 packets to Chicago Lock box via USPS Priority

10/2/2012 Received Date

10/4/2012 Notice Date

10/9/2012 Received text & email notifications for NOA (4 forms)

10/12/2012 Received hard copies of NOAs (all 4 forms- I-130, I-485, I-131, I-765)

10/15/2012 Received NOA with Biometrics Appointment

10/30/2012 Completed Biometrics (completed on date assigned)

12/11/2012 EAD & AP Approved

12/20/2012 EAD/AP Combo Card Arrived

2/6/2013 Notification for Interview

3/15/2013 Interview- APPROVED!!!! :)

O they filed the paperwork for EAD and I-485 in late September received receipts Ocober 10th did Biometrics October 12th 12

ok - is best to call into USCIS, get a Tier 2 Human, an ISO, and find out casefile status,

as MOST of the casefile #s starting with MSC aren't trackable online at the USCIS online status portal.

'family based' only denotes adjusting status from a K-1 or K-3 visa. These 2 types are 'family based'.

HE IS adjusting status from a tourist visa , not a K-1 or K-3, so the topic is in the right place.

If you'd like to learn more about this type of adjustment of status, feel free to study this particular sub-forum.

OTOH, since they only have receipts from October, then I suggest to you that they are 'in-line' on time and timing for the EAD, usually these are issued within 90 days of the biometrics appointment.

'submittal date' is meaningless - what is meaningful are the receipt dates, printed in the I-797-C formletter. They should have 3 to 4 of these , so far.
