They would be denied for abandonment. Per the post earlier today where the person didn't even realise they got an RFE.

I still disagree than a poor response wouldn't lead to denial, but having never received one, I can't be sure.

That's what I figured, but the inadequate response leading to an interview in this situation is what threw me!

OUR TIMELINE

I am the USC, husband is adjusting from B2.

ADJUSTMENT OF STATUS

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

My wife and I have come a long ways on our visa journey, getting through the hardest(and most expensive stuff), but 2 1/2 years down the road during the removal of conditions process, an RFE comes to haunt us. We filed for her removal of conditions in February or March...and waited so long, and nothing. And then this past week we finally got something, hoping it was a letter for approval, but instead an RFE. I thought I had placed a pretty good(and convincing package) together to send to the USCIS, but apparently it wasn't enough to convince them. And my wife is worried they won't approve her. The things I sent the USCIS:

Recent Joint Bank Account Statement

Recent Lease Agreement

2011 Tax Return

401K Form (they claimed we just sent them an application for 401K, that it's not evidence of an account)

One Photo and 2 Post Cards

It is saying we need to submit Financial Records of joint accounts. I thought the bank page was enough, with both our names and same address on it. I don't have certain things, like our car insurance is under my parent's plan...and we don't have a joint credit card. We don't have joint health insurance either. I know that she has a life insurance policy though. We misplaced our W-2's, though I thought I sent them to the USCIS along with the 2011 tax returns. I can get another one, but it takes a week or 2 to get them.

It also says to submit evidence that we reside together. I thought the lease would be good enough. I do have a water/gas bill with both our names on it. The electric bill is in my name and the cable bill is in her name. Can I use both?

My other question is...do people ever get denied the removal of conditions for stupid reasons? I think we have all the proof we live together, it just seems like the USCIS is not easily convinced or anything :/

I am not a big expert on the topic but I am just a little bit curious how you determined that you had sent a pretty good and convincing package for ROC.

I sent in more evidence then that when I sent away for my X-ray classes from the back of a comic book :bonk:

Like a very good friend of mine told me that it is better to send to much evidence than two little! :guides:

not applying to a RFE, in the eyes of uscis, you are in contemp and can be deported. unless you can show proof or having a interview and explaining to them that you had never received the RFE letter. most likely they won't do anything to you becaused there are cases that mail can be lost in the mail. i am not saying that they will deport you, what i am saying is that in their eyes not applying to a RFE, you can be deported but in most or all cases, if you do not apply to RFE, you can explain things to them.

You should reply to the RFE, for sure. I agree it would be denied for abandonment if you did not respond at all.

If your response is still not adequate, they will call you for an interview.
