I will be marrying a woman in the near future in her country and filing a CR-1. She was married before to a US citizen, lived in the US for a short period of time, during which they had a child. She left the USA with the child (jointly agreed) and went back to her home country due to the marriage not working out. She did not get her green card and does not have any status in the USA. However, her child, born in the USA, is a US citizen and has a valid US passport.

Do I need to list her child on the I-864 affidavit of support?

Do I need to do an I-130 for the child, even though the child is a US citizen and can enter easily with her US passport?

Thanks for your feedback.

1. You only sponsor YOUR household size as it is currently, plus any immirgants so... no the child isn't listed

2. No.
