I would not be so sure they will strike down DOMA. Though I would like to see them rule that the Federal Government has no business in marriage...because they do not.

And that is the only answer. The Government gets out of the Marriage business all together. If two people want to get married in a church and let that church define their marriage, then have at it. The Government would not issue marriage certificates etc. They would just stay out of it.

And when certain pseudo couples want benefits for both as a married couple because one of them works for the government...well the government needs to say no because they are staying out of it.

What benefits? There would be no benefits for married couples. As far as the government is concerned, there would be no such thing as a married couple. Not that it would be the biggest impact of this tremendously stupid idea but none of our spouses would be here because the immigration path they took would simply not exist. So, look at your spouse and then think once more about whether or not you'd really want the government to get out of the marriage business altogether.

Did I say I wanted the government to stay out of it? You might want to read back a couple of post. If I had my druthers the government would put an end to this nonsense and start immediate deportations on anyone in this country that claims to be a liberal.

Yay! I'm looking forward to the day that same-sex couples are afforded the same rights to spousal immigration and join us here on VJ. I'm not sure what's going to happen in the Prop 8 case, but I am feeling pretty positive that Section 3 of DOMA will be stricken. We have 9 states and DC issuing marriage licenses to same-sex couples with several more states moving towards marriage equality in the very near future - that's a large part of the country for the federal government to refuse to recognize their civil marriages. The Supreme Court doesn't have to be very bold to say that the federal government should recognize the civil marriages provided by states (as they do for all other marriages). I hope that I'm right.
