hello all, i really need advice, I was in the U.S. for 3 times entering on a tourist visa, someone can tell me if the fact that I have entered as a tourist and overstayed can be interpreted as misrepresentation.

Only if you said you didn't overstay. As long as you tell the truth, you will not be accused of misrepresentation.

Misrepresentation is defined as any manifestation by words or other conduct not in accordance with the facts; an untrue statement of fact; an incorrect or false representation which, if accepted, leads the mind to an apprehension of a condition other and different from that which exists.

BSD is correct. You may still need a waiver for the overstay, depending on how long it was, but it is not miss-representation unless you lied. However, did you get three tourist visas and overstay every time? If so, did you lie to get the second and third one?
