Hello guys!

I would like to hear any pieces of advice for the situation that not long ago took place.

I went on K1 visa to the US in april, 2012. till the start of july we had to get married but it never happened. Then I overstayed one month, and went back to my home country. But here is the thing I want to get your pieces of advice or any ideas. While I was staying in the USA many awful things took place, after what in the end I realized that my fiance lied to me, and brought me to the USA to work for him, and nothing else. During my staying we never went anywhere together, never spent time together, he never stayed at home (just several times, the rest of times he slept at grandma's house), he made me work at his restaurant saying this was help (but i realized it was illegal, and din't want to do it), didn't pay me, didn't care about me, wanted me to stay for longer telling like we would marry later, didn't want to buy airplane tickets (thats why I overstayed). Now almost four months are gone since that time. Is there any way to punish him? by US law for his actions?

I understand it sounds crazy. But sometimes life brings such "presents" that you wish you never get.

It doesn't sound like he did anything illegal, other than possibly having you work at the restaurant. He may not have been nice, but at least you are home safe.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I'm sorry but he didn't really do anything illegal. Helping at family restraurants isn't really "illegal" (as long as you aren't taking over a paid position) but as you weren't married it could be said it was... however you have no proof and it's been too long.

If you were to call the police they'd most likely tell you that you aren't there anymore so you're not at risk but outside of that, they can't charge a guy just 'cause he did some mean things to you... otherwise there'd be a lot of people in a lot of trouble. Some people are just bad people.

If you want to send a letter to USCIS telling them that you believe that he imported you as a slave and when you didn't perform he sent you back, go ahead. But you're unlikely to hear anything, and they're unlikely to do anything about it... believing you're just a scorned ex.

In my profession we are taught to write notes so we know for future incidents.

I'd recommend writing to the USCIS and telling them what occurred. This way, if it happens again the man will have difficulty doing it ever again.

There is no criminal acts apparent here. There is no immigration fraud. (If he has done this to another girl, then you can show a pattern of abuse. However, it's unlikely that he has filed multiple K-1s.)

The only thing you can do is sue him for back wages. However, you would be admitting that you worked illegally in the US which could affect any future in the US.
