She was denied an K-1 visa less than a year ago with another man, you met and immediatly filed the fiance visa?

Is this correct? I'm not judging it is just you gave such little info that we are trying to help you.

Please explain, what was the misunderstanding? What was the quesitons and the responses

I appreciate all of the response so far. Okay let me try to add some history here so maybe I can get some suggestions and some help rather than just criticisms. We met 6 months ago and we talk almost everyday morning noon and night. She has a married sister living in the US for the past 3 years who I also talk with on a regular basis. Also spoke to her husband who met the entire family. The both assure me she is a good girl and comes from a good family. The subject never came up until recently when we began getting real serious with each other. She told me about being denied a fiance visa on Dec 14, 2011 with another man. She emailed me the documents showing the reason for denial and when I saw that I was shocked. She is also very upset to be considered a prostitute when she has never been involved in that kind of work and has not worked in any bars. She works in an internet cafe. She is from Samar but now living in Angeles City. I think the interviewer already believes she is working in a bar just because she lives in Sin City. So at the end of the interview he began to ask her about her work and kept on insisting that she works in the bars as a prostitute even though she kept on denying it until she says he started to talk very loud accusing her and she became very scared and nervous and said yes just to end the interview. i have yet to visit her in the Philippines and I have not applied for any sort of visa. I am thinking to marry her there and try a spousal visa. I only sent her money for her birthday so she could buy a gift and have a cake and some foods for her friends and relatives. I attended the party myself via web cam. Sorry this is so long

Thanks for more info but I still think there may be more to the story, OP. Why was she denied last time with the other man? It may be a combination of her first denial and then of course her admitting to prostitution. Pressured or not, she said "yes".

My advice, get a GOOD lawyer who specializes in Immigration and waivers. Expect to pay a LOT of money. There were a LOT of red flags to begin with that didn't help your case. Your lawyer is going to have to address ALL of them. The first denial AND her admitting to prostitution.

EDIT: Wait, I missed this. You said you have yet to visit her in the PI? Have you actually met her in person??

You also missed that admition of prostitution was when she tried for K-1 firrst time in 2011.

OP did not petition for her yet, he is just concerned that previous denial will play role if he starts the process now.

You have not met? I assume she was not applying for a K-1 visa at the interview, there is no way your petition would have gotten that far

What visa was she applying for?

Ah gotcha, so she applied for the fiance visa with this other guy, was denied due to Prostitution and now you two are engaged but have not file for any sort of visa.

But she did say yes, she admitted to the prostitution.

It is lawyer time, I suggest Laurel Scott, she is an expert in inadmissability. She offers free chats on wednesdays

Just FYI, there's a new breed of "prostitution" going on here in the Philippines, which is prevalent in some provinces, that is the "cyber-sex dens". Women are employed in an "internet cafe" sort-of environment where they do "shows" for their foreigner clients via webcam.

OP by the way means Original Post or Original Poster (the person that started the thread). Any woman that works at either a bar or net cafe will be placed under SEVERE interrogation for the exact reason that tripped up your girlfriend. Anyone that has engaged in any form of prostitution (even if legal in the country of origin) cannot be issued a visa to enter the US. Living in Angeles only makes her even more suspicious. The best you can do is when you apply for a visa waiver. You may have to wait until your own application has been denied though before you can apply for a waiver. Given this problem you may need a lawyer.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
