Hello. You need to give us more information. In addition filling out your timeline may help us as well to see if you received an RFE's. Just so you are aware, It is illegal to petition a person that was or is a prostitute. I believe everyone can change but the USICS has to protect both the USA and the fiancee due to "Human Trafficking" You can appeal if believe your fiancee just was confused and answered wrong.

She was previously engaged and applied for a visa with someone else and was denied December 14,2011. We met 6 months ago and we are serious. She told me she was tired and confused at the interview and answered incorrectly. I have talked with her relatives her friends and co workers and they all tell me the same thing. She has a sister in the US who also tells me the same. Her NBI clearance shows no derogatory record.I don't know how the embassy could make that assumption with out proof

There are so many things wrong here - where to start? First off - is she your fiancee or spouse? Second - why was she denied last year?? Third - Her relatives and friends tell you what? That she isn't a sex worker or that she botched her interview? Fourth - She must have been a real mess at the interview to tell them she's a sex worker if she isn't. Something here smells very foul. A clean record means nothing. She could still very well be selling her body for money and just never been caught at it. And if she told them she is a sex worker (unlikely) or they found seedy connections in her background check (most likely) - that is all the "proof" they would need to deny.

I don't know if it would help to contact the embassy or DOS to try and make the case that it was a mistake. It wouldn't hurt but no guarantee that you can salvage this.

What do you mean assumption without proof? She told them so in person, correctly or incorrectly. What other proof do they need?

Speculation on the part of Consular Officers is what leads to many denials, rightly or wrongly. In fact, US courts have upheld the Consular officers' right to speculate and not prove in case adjudication. Above I was just elaborating on my point of how a "clean" police record doesn't mean anything. She may not be a sex worker but she was still denied a visa previously with a different petitioner. The OP's should have wondered why. Seems the Embassy in Manila did their jobs.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The speculation was on my part, I was merely adding to your elaborations, “sex worker” as for the rest of what your saying, that is no new news, too me.

@MX65- I think I understand what you are talking about. I had a similar situation with my mom, a little different. My mom had the Citizenship interview, and I went with her. After asking her all the questions, at the end they asked "Was everything you said is true and accurate to your knowledge". My mom said no by accident, she was nervous. The interviewer didnt even wait for split of a second, and denied her. Of course, she got the citizenship on the next interview. Anyway, I just want to bring this to everyone's attention that some of these Immigration officers are not there to help you. They look for every loophole possible to deny you.
