Since VSC is so slow and I am looking at having my NOA2 in Jan or Feb I assume I will need to file taxes for 2012 before I send my I-864. I have already requested my transcripts for 2009 2010 and 2011 but am I right to assume I can't use 2009 and will have to include 2012?

06/11/2012: Married

07/03/2012: I-130 delivered to Chicago

07/06/2012: NOA1 VSC

07/11/2012: Received paper NOA1

02/27/2013: Received NOA2 Email that we were approved

03/01/2013: Recieved Paper NOA2

03/04/2013: NVC received

03/21/2013: NVC Case no. assigned

03/21/2013: DS-3032 emailed

03/26/2013: Resent DS-3032 email with Supervisor Review

No, they won't ask for tax info for 2012 until after the deadline in April to actually file 2012 taxes. You can submit them, but it shouldn't be a requirement.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

It depends on the date. If you can file your tax return in February, then it would be best to use 10,11 and 2012. Remember that your current income is a separate question, the answer to which is unlikely to match any numbers on a prior tax return, even as recent as 2012. The income on tax returns section is not directly related to the current income question unless self employed.
