Ok here's the deal!

I got my Fiance and her daughter here in Aug. of this year We got my fiance her Social Security Card also tried to get her daughter a card too but they said she couldn't get one now had to fill out some form i forget the number on the form or what form? Then about month later we got married went back to the SS office to change the name on the card and then we went to get an I.D card from the dept. of public safety but let the I-94 expire 4 days before doing it (work related)So the thing is we haven't done the AOS yet having to wait till income tax get here (again job related) called my tax guy about the daughter he said i can't claim her without a number meaning Social Security Card# The daughter is only 8 and came here on a K-2 visa on here mom's K-1 visa what should i do? Are we in trouble? I know it took me a year to file my AOS on my first K-1 visa wife had no problems, But on this time around we have a child involved they have only been here going on 4 months, any help would be greatly appreciated. thanks

I have a K2 and we filed for AOS 6 months after getting here, 5 months after marriage. When we filed I also filed for EAD/AP combo card. When we got those my daughter was able to get her SSN. We didn't wait for the next tax year, we just filed using 09/10/11 tax details. If there is a problem you could apply for EAD separately then AOS after the tax year is finalised, I think.

Filed 15th June, 2012
NOA date 18th June
Bio appt 20th July
Transferred to CSC 21st July, 2012
EAD/AP approved 27th August.
Received Green Card 6th October. No Interview. Amazing!
Thanks for all the help, see you again in June 2014

ROC Timeline

Mailed Package 30th June 2014

I-797 received 5th July, 2014

Biometrics Appointment 07/30/2014.

we areon the same situation...we came here last sept with my son(k2) still he dont have ssn#...i will send EAD at the same time with the aos package so that it will no cost if filed with i-485,well correct me if i wrong...at this time still preparing for the papers and docs needed for aos....i want my son to have sss # so that next next year he can be included at my husbands' tax...the atty told us that we should first file an AOs before including my son as dependents....

ya, k-2 cannot get ssn without either an EAD or a GC.

Darnell is correct.

My wife (K-1) applied for her SSN shortly after we received the certified copies of the marriage license. She got it, six weeks later (that is another story about the CBP). My step-son (K-2) was only able to apply and receive his SSN after he presented his EAD/AP combo card.

That's what i meant doing the taxes for 2012 year so in feb. 2013 we will do it! The reason waiting so late didn't know my ex wife was going to take me to the cleaners. Changed my income greatly!!!!!!!! but we will manage.
