Hi

I know what this was stupid but it is done and all I can do is move forward and mitigate the damage. My spouse entered the country on a K1. We were married and filed the AOS application. About two months after filing we started havign problems and I strongly considered divorce. We had a lot of adjustment, compatibility issues and frankly I was very scared about signing the I864 when I thought my marriage was in trouble. I was very stressed and panicked (somewhat) from visiting this site too much and really stressing about being financially responsible for someone for 10 years when I wasnt sure my marriage would last a quarter of that time. Anyhow I wrote a letter to local USCIS office and told them I was planning to divorce and wanted to withrdaw my I864. I actually filed for divorce but withdrew/dismissed it. I think stress was a major factor and bottom line when push came to shove I realized we had gone through to much to be together and I shouldnt give up so easily. Also I honestly was looking at marriage to lightly and for long time just kept thinking I will just end it ...wrong attitude.

In my letter I told them that I underestimated the cultural and age differences and that we both were having adjustment issues. I think we both became stressed and very depressed for different reasons. I am older and probably more set in my ways and didn't know we had so many cultural difference until living together. Not things like housekeeping but just how we view and approach things. Also sitting at home too long took a toll on my spouse.

Last we have had some domestic issues and the police have been to the home when things got out of hand. No one was charged and they just made us seperate etc. I know USCIS could probably get this information but is it likely. No VAWA situation here just arguments that have gotten out of hand. We have both agreed this can't happen any longer and have stuck by that.

Okay so long story short we are working on the marriage and due to start counseling. We are working through our problems better and learning to cut each other slack.

We received letter from USCIS that we have an interview. I think the local office interviews everyone but I am sure we would have gotten one becuase of my letter anyhow. When I visited the local office two of the counter people told me this happens all the time. I am hoping that is the case but I KNOW we have to be PREPARED.

My questions here:

1. Do you think I have done a lot of damage

2. Should I get an attorney to go with us

3. Has anyone ever been in this situation with considering divorce and notifying USCIS and changing mind?? (MY MOST IMPORTANT QUESTION)

4. Those of you that have had interiews (even without the divorce issue). What was it like.

5. How personal do you think USCIS will get? There job really is to figure out if marriage is legitimate not if the marriage will last right???

here is my advice,go to the interview as you are guys.no attorney no nothing,

got a problem during the interview?no approved regarding your issues?no problems.

your wife going no where.

work on our marriage first and make it better then work on the papers.

don't coast your self for attorney.

I dont really understand some parts of this-

you submitted the AOS (OK) then you sent a letter to your local office telling them you were planning to divorce and wanted to withrdaw my I864 (OK), then you say you got a letter for an interview (what kind of interview? the big GC AOS interview/bring your spouse or a ####### is this letter you sent is interview come in and talk to us interview?) then you say "When I visited the local office two of the counter people told me this happens all the time. I am hoping that is the case but I KNOW we have to be PREPARED" So are you saying you went to the local service center? What exactly for? To ask about the upcoming interview?

But to answer your question, it is my opinion that it is based on the marriage being legitimate and not on whether the marriage will last. If it the AOS interview they will probably bring up the letter (if they did infact receive it and it was correctly identified and attached to your case) You may have to sign something withdrawing your request to cancel your request to cancel out your previous request.

If its not the AOS interview then its a formal interview for you to come in and formally withdraw your 864, at which point you would go in and explain you reconciled and no longer wish to. Like I said you may have to fill out some kind of form to withdraw your request and apologize.
