Hi! I am December 2012, i130 applicant (beneficiary) and my file is at NBC like most of you guys Priority Date Dec 17, since we all are still awaiting the NOA2, I was wondering if I can get a L1 Visa and go to the US for work purposes. However, i still want the CR1 Process to continue and not interfere with it. I have read on a number of places, that L1 is a dual intent visa and one can apply for it while the CR1 process is in progress.

I also have a B1/B2 Visa but am not planning to visit the US as it can lead to several questions.

Any opinions ?

Visiting from Canada is not an issue.

As long as you bring ties to return to canada, and a copy of your NOA1, you're usually fine.

I would like to visit my in-laws sometime this year but am worried I'll have problems crossing over to the US. I can definitely get an employment letter from my office but I still haven't received a hardcopy of my NOA1. Please advise.

Visiting from Canada is not an issue.

As long as you bring ties to return to canada, and a copy of your NOA1, you're usually fine.

Your actual question, I cannot help with.

I have already made a trip to the us and returned to Canada after I filed my i130, but my original question is that I need to go there on work as my company is looking for a project for me.

This is what I did,

I did not take a copy of my NOA1, as I didn't have it, I took the following to show ties with canada

1. Current Phone, internet, Cable bill copies

2. Copy of my employment letters

3. Copies of my last 6 months pay stubs

4. Copies of my apartment lease in Canada

5. Copies of my Car leases and agreement

6. Copies of my current credit card bills

At the border, I wasn't asked any specific question and i told I am going to see my family friends, which i actually was. He did not ask anything about my i130 process and neither did I mention. he checked my passport and let me in.

However, i was always prepared for secondary investigations and you shold be too as I did not lie.

Did you guys file abroad?

By that I mean, is your USC spouse living with you in Canada and you expected to receive a paper NOA1 at a canadian address?

That could be why you haven't received it yet.

Do you have an email NOA1 that you could bring?

When visiting your spouse, you really really need to bring that along with you.

My CBP office was even rude about telling me that I should ALWAYS carry it with me.

(Like I didn't know HELLO here I was crossing with it!)

Anyways, don't be afraid about crossing.

Canadians do it all of the time.

Bring anything you can that proves you'll go back to Canada and be honest at the border and you shouldn't have any issues.

My husband is red flagged in the system and we were able to cross for 2 weeks last month so, as long as you're honest and your ties, no concern.

Of course, there's the disclaimer that you could always get some cuckoo-off-his-rocker-crabby officer that could deny you.

But that's the case even when you aren't in process of immigration.

yes we filed abroad and expecting the NOA1 to be mailed to Canadian address. It's been a month exact since we received our NOA1 email...not sure if I should call in and inquire abotu that.

Well at least my estimated date for the adjudication of my 130 (according to visajourney) has stopped moving farther away! (and i know it will change again and again, but seeing it move further and further away was getting disappointing)

I have just started to become calm with the process now my husband is starting to stress :bonk: I know it's a long process and there are many people that have been waiting for a very long time. But this week I am feeling a little selfish and just wish I could see some progress on it ....just so he would be a little less stressed.

12/3/2012 - I-130 delivered to Chicago 5/20/15: mailed I-751 package to California office
12/4/2012 - NOA1 NBC (Missouri Service Center MSC) 5/22/15: Date on NOA1
12/6/2012 - Check cashed 8/26/15: Bio appointment

12/8/2012 - Received paper NOA1 10/06/15: Received Email card was being processed
12/20/2012 - Case number showed up on USCIS website
1/29/2013 - Called USCIS and case is still at NBC

yes we filed abroad and expecting the NOA1 to be mailed to Canadian address. It's been a month exact since we received our NOA1 email...not sure if I should call in and inquire abotu that.

has there been any approvals through NBC for December filers yet??

Nobody realistically expects there to be, but some may have been expedited or exceptionally lucky.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

How did you find out your address was changed??! My worry is if I can't even get my very first piece of official letter (NOA1) now whether it was lost on the way or wasn't even mailed, how am I going to get the other more important paperwork from USCIS?!

Well they sent the notice that I, the USC, had changed address to the US address they insisted I use. The only way we found out that they had changed my husband's address to a US one was the congressional inquiry. :thumbs:
