Guys! Anyone heard of any approval recently! I'm a Decemeber i130 filer too and have had no response since the NOA1 I got mid december. My wife called USCIS and they told that my file was probably at the Newark Office. that's pretty much it, thats all information I have. Any ideas how long this wait is gonna be.

There have been some approvals, but very few. Out of some 10,000 cases at NBC that they received during mid December, they are approving about 300 a week. Check out some data here:

06/19/13- DS-3032 emailed 12/23/13- SSN card arrived in the mail

06/21/13- AOS bill paid 02/06/14- ELIS: Circle: Optimized, Status: In Process

06/25/13- DS-3032 accepted 02/07/14- USCIS status: Initial Review

06/26/13- IV bill paid 02/10/14- USCIS status: Card Production

06/28/13- AOS and IV packages sent 02/13/14- ELIS Circle: Closed, Status: Card Produced

07/23/13- IV accepted 02/15/14- card arrived in the mail

07/26/13- AOS accepted

07/26/13- Case complete

07/30/13- Interview scheduled (for 09/16/13)

Guys! Anyone heard of any approval recently! I'm a Decemeber i130 filer too and have had no response since the NOA1 I got mid december. My file is at Newark and I am still waiting. 2 cases I know got approved in past 10 days from Newark, both cases had same NOA 1 date (10/02/2012) and got an RFE in early march. So I am guessing that after an RFE cases takes month or so to get NOA2. Early last week I contacted my congressman who contacted Newark office and after 2 days I received an RFE which does not make sense. They want me to resubmit my G325A which I did. So I am guessing if you have your congressman inquire, they may move fast. Also, I suggest you visit Newark office with an infopass.

06/04/2013 - AOS & IV bill e-mail received, generated and paid.
06/05/2013 - AOS & IV status paid.
06/05/2013 - AOS package sent
06/12/2013 - IV package sent
06/25/2013 - AOS Accepted
07/03/2013 - IV accepted
07/03/2013 - Case Complete
07/30/2013 - Interview Date received

My question is now on the next phase...on this page:http://www.visajourney.com/wiki/index.php/How_to_bring_your_foreign_spouse_to_live_in_the_US

it says the 864 and 230 forms are independant tracks that run parallel, but how exactly does this work? I thought I had read once that you do the 864 and then immediately following that the 230...so can anyone tell me which it is? Do them at teh same time or one after the other?

My understanding is that I 864 is done by the petiotner/sponsor and DS 230 is done by the beneficiary. Beneficiary has to fill DS 230 and mail it .

I 864 is first and DS 230 follows after it.

Dec 09, 2013 : Case reached NVC

Jan 08, 2014 : NVC assigned Case Number

Jan 15, 2014 : Paid I 864 (AOS) bill online

Jan 16, 2014 : Completed DS 261 (choice of agent) online

Jan 21, 2014 : Express mailed AOS package

Jan 27, 2014 : Paid DS 260 bill online

Jan 29, 2014 : Express mailed DS 260 civil docs

Jan 29, 2014 : Submitted DS 260 online

Feb 13, 2014 : Received False checklist for civil docs by email

Feb 24, 2014 : Case Complete

April 14, 2014 : Interview. YAY!!!

Any December filers who is waiting NOA2???

Me too.

No local office transfer got stuck at NBC.

Yesterday tried to get B2 on the new passport and got denial.

This whole process is a joke protest6wz.gif

I finally got approved !!!! It took 6 month 13 days of waiting 2 info pass and still going to me 3rd one on the 21st. also i sub.3 service request. But I finally got it .. I wish you all the best of luck and the best advice i can give you is don't be patient, contact them by all the means you can and let them know you are tired of waiting

Those two do run in parallel, but it usually happens that they ask for 864 first, then 230. You will not send any of those until NVC is ready for them.

The way it happens, you'll send 3032 as soon as you get the case numbers. It takes some time (1-2 weeks) for them to accept that, and you won't be able to pay IV fee until that's accepted. You can only send 230 after the IV fee is paid.

In the meantime, they'll invoice you for AOS bill. As soon as you pay that, you can send 864.

Congratulations on your approval, you are right we can't just sit and wait, I will tell my husband to get an appointment for infopass.

When you went to infopass could you get any information?

Thank you so much... And yes you must get in contact with them any way you can. I would call and speak with a tier 2 twice a week. I also made two info pass appointments. The first one was useless but the second time i was able to sub. a service request in person. The officer handed me a form that he had me fill out to give to the officer assigned to my case. The question you need to ask is:

When was my case transferred?

Has my case been assigned to an officer already?

When was the last check in done on my case?

These well help you estimate at least when you will be hearing from them. I was told to weeks ago that my case was checked in to and it was assigned back in may. I wish you the best of luck and remember keep on insisting...

Just don't waste time and money like I did for applying for a B2 visa.

Better get a ticket to your country for your hubby.

This process got separated us for 9 months already but at least my spouse has visited me two times for 6 weeks total and we had our honeymoon and a honeymoon reloaded all over the Europe :D

There were no questions at all as my papers were just perfect.

The simple thing they got onto was like we cannot issue you a tourist/visitor visa as you have already applied for immigration visa,

so you stated clearly by petitioning your intent is to immigrate to the US and this prohibits us to issue you a visitor's visa.

You can preload it with documents showing you are attached to your country as much as you can at the interview,

they just do not care. You are considered as a potential immigrant the way they do not like (applying from the US) so there is your denial.
