Hi vj family.. Here's my situation now, a good friend that I met here in vj (she is working at the court) referred an atty. and I am currently negotiating w the atty. his payment is 40,000 php to cover my daughter case. He suggested to run a correction of entry which I need to take an oath w the consul of Phil embassy here in US ( which I am not sure where is at) he gave me a timeframe of 3-4months to have my daughter birth certificate corrected. (Actually depends on court if how slow they are) if ever my daughter birth certificate get corrected in 4-5 months, will she be able to come here as k2? My visa was issued in August 2012..

Please enlighten me and give me more advice..

Her K2 must be issued within one year of the date your K1 visa was issued. If you can get the correct documents together with sufficient time remaining to schedule an interview and get the visa then it should be ok.

What's wrong with her birth certificate?

My parents is listed on her birth certificate as her parents instead me the biological mother.. What would be your advice?

The child of a fiancé (e) may receive a derivative K-2 visa from his/her parent’s fiancé (e) petition. You, the American citizen petitioner must make sure that you name the child in the I-129F petition. After the marriage of the child’s parent and the American citizen, the child will need a separate form I-485 Application to Register Permanent Residence or to Adjust Status. The child may travel with (accompany) the K-1 parent/fiancé (e) or travel later (follow-to-join) within one year from the date of issuance of the K-1 visa to his/her parent. A separate petition is not required if the children accompany or follow the alien fiancé (e) within one year from the date of issuance of the K-1 visa. If it is longer than one year from the date of visa issuance, a separate immigrant visa petition is required.

The same penalties shall be imposed upon any person who shall conceal or abandon any legitimate child with intent to cause such child to lose its civil status.

Any physician or surgeon or public officer who, in violation of the duties of his profession or office, shall cooperate in the execution of any of the crimes mentioned in the two next preceding paragraphs, shall suffer the penalties therein prescribed and also the penalty of temporary special disqualification.
