Hello! Could you share your experience of getting a permanent green card after getting a divorce while having conditional one. was it very hard? is it possible to to file successfully on your own with little evidence? just want to be prepared for everything. when marriage if falling apart it is good to know what could happen. in my case my husband threatens to kick me out every time we have a little fight, keeps divorce papers in his desk (which makes the whole situation unbearable) i am tired of him saying i am worthless and stupid. i love him, but i feel that he is destroying me. i've had my card for about 9 months now. please, share your experience! i will highly appreciate it!thanks!

What your husband is doing is considered emotional abuse. In the event of a divorce yes you can do ROC without him look over the USCIS website and do a search here to find the steps on how. If you want to try and make your marriage work then do that, if you want a divorce then do that. If you need assistance look over this website. Best of luck to you what ever you decide.

it sounds like my story... if you think a divorce is the only solution, keep in mind that with the waiver paperwork u have to send the divorce decree, so if in your state it takes too long to get a divorce see if u would be able to have it final before your green card expires. It's not impossible to file and get approved when the divorce is ongoing at the time you file, but it might take more time.

Also, if your husband abuses you emotionally, I would not be surprised if by the time you have to file jointly he would decide not to cooperate. My husband was crazy and would do anything to make me crazy/sad/feeling like i was worthless/was always saying he would send me back to brazil. The best for me was a divorce. At the time I didnt know I could apply for the ROC being divorced and was ready to move back. Left the marriage VERY happy even though I thought i was going to get deported.

My ex would also make it more difficult for me to have any of the bona fine evidences. A divorce should be the LAST option, but I think emotional abuse is very hard to fix...... here is what i sent:

• Form I-751 based on marriage entered in good faith but terminated through divorce.

• A check for $590 from my checking account.

• A copy of my permanent resident card.

• A copy of my marriage certificate.

• A copy of the divorce decree and case notice.

• A copy of the lease for ... Hamden CT and a copy of the lease release and security deposit refund to us by the lease holder when we moved from Connecticut to New York in mid June 2011. Copies of some of the rent receipts.

• A copy of the lease for ... New York NY and a copy of the lease addendum when .. left me. Copy of some of the rent receipts.

• Pictures from when we were dating (Summer 2008-May 2010).

• Pictures from after we got married, including pictures of a pet we bought together in September 2011 that now lives with me.

• Seat requests and boarding passes from when we went to Disneyland (July 2011).

• Sworn affidavit from ...(my brother-in-law).

• Sworn affidavit from ... (friend).

• Renters insurance for our apartment ... Hamden CT.

• Car insurance ID cards and agreements for our cars in both of our names for both addresses (Hamden CT and Bronx NY).

• Health insurance ID card.

• Dental insurance ID card.

• Credit and debit cards from joint accounts we had together. All the accounts we had together have been closed after the divorce in March 2012.

• Copy of holiday cards and letters that we wrote each other and his parents wrote to us, miscellaneous correspondence and cards from others to us.

• Copy of 2010 joint tax return.
