My fiance and my paperwork was sent back to the USCIS it has been an up and down battle to get it there. The consulate in Casa told him they would send it back by August well it was October and nothing had gotten done in the end of that whole ordeal they finally our papers were sent to the USCIS office in October. It was the end of November and I got all new paperwork started to send off I was planning on sending it off next week, to start the process all over again. (I herd when the paperwork gets sent back it never really gets touched)

Sooo today I got an email saying that USCIS has just received my paperwork. I am not sure whether or not it would be a better idea to cancel my old paperwork and send off a new packet to start over again. Or if I should go ahead and continue with the original paperwork. (I have herd that once the paperwork gets to the USCIS office it doesnt get touched for an entire year).

I just need advice. Or if someone else has gone through this before if they could provide their experience.

Timeline

Before filing a new petition you need to find out and address the reason/reasons why the first one was denied in the first place. Merely filing a new petition will not help unless you fix what is broken.

Do not file again yet. First, you must find out why it was sent back. Filing without fixing the issues will trigger a denial again.

Don't ever do anything you're not willing to explain the paramedics.

Yeah, thats the problem. I have herd through many people that they never hear anything from the USCIS office. They never get back the reasons they were denied in the first place nor do they find out if they are re approved or denied. I just dont want this entire year to pass and no process made.

It's not the USCIS that everyone is talking about since your petition was approved and then forwarded on to the Embassy. You need to find out what went wrong during the interview that the visa was denied which resulted in your case being sent back to USCIS. Because if you send it again and don't know what went wrong at the interview, you will send the paper work again, USCIS will approve the petition again, then the Embassy may deny the visa again. Hope everything works out for you.

I don't think its always possible to find out the "reasons" for a k-1 denial in Casablanca. When my husband (fiance at the time) was denied I tried time and again to get a reason and all the Senators office could get from them was just the statement , they doubted the validity of the relationship. Well that is pretty much what a 221g means is lack of proof or evidence/validity. Not one mention of what the CO stated for reasons. I know now from a lot of reading on this wonderful site that it was probably a handful of things, short time of relationship, one visit together, his english wasn't so great, and we had a 10yr age difference. We fixed all but the age difference, can't turn back the hands of time or fast forward.

As for the k-1 its still sitting in VSC untouched since it returned March 2011, interview was Dec 2010. We finally decided to get married after the senators office said basically there is no review, however according to USCIS the k-1 is still in review HAHA. We are now awaiting our NOA2 for I-130, so as you can see its been 1 yr and 9months since the k-1 returned to VSC. K-1 visa's are not so easy in Casablanca, you might get lucky but most don't.

I would be interested to hear how others find out the CO's denial reason.

That's what I was wondering. I wonder if this is only the case for k-1 visas in Casa. My fiance and I are going to give it another go.

yea i really dont think you can find out the detailed reasons it was sent back. Everyone tells u to find out the reasons but no one from morocco that i know of as ever found out specific reasons for a k1 visa petition denial on their own without the USCIS volunteering that info. If u want to continue with the i-130 without wondering if its gonna be a problem in the future, then maybe u can find out someway to be sure of the old K1 being closed. iDk. We got denied for K1 and decided to just go ahead and send the new one I-130 petition. When i called to ask about how i should close it and that i want to cancel it the operator just told me that it would be closed automatically cuz we were now married but now im wondering if that was tru or not, cuz it seems as if they are now making us wait the time for the old K1 to be approved and the I-130.

That's what I was wondering. I wonder if this is only the case for k-1 visas in Casa. My fiance and I are going to give it another go.

In the same boat as others based on what I am reading. Consulate in Morocco is well less than responsive to emails and phone calls, at least when you get a human they do know how to say the same thing over and over.

Our paper work is being sent back but after 5 weeks it is still sitting at the Consulate and the man on the phone keeps insisting it was sent back October 31st. Told we cannot have a senior officer review since it was already sent back.

Called Diplomatic Pouch service only to find out it was not registered, then registered to be mailed then it was un-registered two weeks later.

I wish everyone the best! Thank you for putting information on here, it at least keeps us all informed.
