Hey guys, what an awesome place this forum is.

I am in somewhat of a "unique" situation. I've been in the US on F1 visa for 6 years while I got bachelor's and master's degrees. Then I got OPT for a year. OPT expires mid January 2013.

I've been dating my fiance for year and a half now and we would like to get married and file for GC.

My issues:

1. She lives and works in NYC, and I currently have a job in Atlanta. Would having jobs so far apart be good enough of a reason for them not to doubt us? Would this be a problem, in other words?

2. She is 10 years older than me. Is that an issue?

3. She hasn't filed taxes in last two years and is working on fixing it this year. How would this play into our paperwork?

1. It's a red flag, but you have a good reason. What are your plans when OPT is done? How often do you see eachother?

2. Probably not, considering the country you are from.

3. Why didn't she file? If she wasn't required, then no problem- she just writes a letter explaining that. If she fell behind, she needs to back file.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1. Once my OPT is done, i will move to NYC with her, as I have 60 days grace period after the OPT.

2. Considering the country? How does that play into it if you don't mind me asking?

3. She fell behind, yes. Would she need to back file before all the papers are sent in or could it be done after?

2. In some countries, it is extremely unusual for the wife to be older, especially if the wife is past childbearing age. In such countries, this would be a red flag. You are from a European country so this should not be a major issue.

3. You are supposed to send tax papers with the I-864; if you do not, they will likely send an RFE (request for additional evidence), which will delay things.
