K1 visa DENIED - Public Charge - pretty outraged.

I agree that applicants have the responsibility of proving they have evidence. And I COMPLETELY agree that the Counselor Officer doesn't operate alone and in a complete vacuum. They are supposed to follow the regulations which are provided in the instructions of the packet. That's the whole problem.

Weddings and marriages are something that people plan. It's in a sense the creation of a family. If someone provides all the evidence requested by the law and an individual still says that it's not enough, then they must be basing decision in something other than the law. If that is the case, what is it? I am an American citizen and I wanted to do this in an honest way. I provided more than the necessary evidence that my fiance would in no way become a public charge. We wasted so much money only to be told we didn't have enough! It's ironic that we will have a lot more expenses now that we have to continue to travel back and forth...and not having the comfort of rent-free living in an owned home that we could have had here.

The word Consul means advice giving. Shouldn't they at least respond to emails or provide some information when people are paying 15 euro to make calls. Don't get me wrong, they Officers I spoke with seemed very nice and polite and I agree it's the system not the individuals, but shouldn't the system be more transparent. I would appreciate a clearer motive for our visa denial since it has shattered everything we have been planning for for a year. Shipping clothes, moving, changing jobs, visits and other things we have done to try to get ready for a life together.

This is exactly my bone of contention right there.

In my case I would like to know what constitutes a bona fide relationship and exactly from the point of view of the embassy. And what further proof other than marriage that we already submitted is necessary.

So they told me that the Consular Officer did not feel that the applicant proved the relationship. They never said the team, they said the Consular Officer. They also said they do nto escalate any appeal to another CO or higher up. So you Guys that still feel that it's a team meeting decision might be wrong. At least for Lagos anyways.

Yes I know that it's a privilege and not a right but make the process straight forward and remove any ambiguity. We already know that rapists cannot apply, and that you need to make 125% or have a sponsor (well I thought so for the sponsor). Just make the rules clear for this priviledge.

You desire an objective and concrete answer to a question Consular Officers decide on a more subjective basis. There is not and likely never will be the concrete answer you desire. If for no other reason, it is because the fraudsters would find a way to "meet" any officially defined objective criteria. Sometimes we just don't get what we want, no matter how loud and long our tantrum.

Stop confusing genuine concern about lack of adequate direction of a process with tantrum, perhaps it describes your position but not mine.

The word tantrum was not directed to you. I made a statement of fact regarding your concerns. You haven't thrown a tantrum but even if you do, it won't get you and objective answer to a subjective question.

Status update: We had our interview at the consulate on the 29th of January. We came armed with a job offer letter (which we didn't have to show), an employment letter, a pay stub and my job contract. My fiance went to the counter with the letter we received from the Vice Consul (we had one from the Consul as well), showed the lady at the counter the rejection letter who then went back to check with the VC (Vice Consul) to ensure she had not sent back the documents. She then asked for the proof and the i-134 and then had her sit down and wait. About 30 minutes later she was called to the counter, and told that her visa was APPROVED!! She was told she could pick it up the next day at the MailBoxes location (this document was actually not received until 3 days later, and delivered on Monday (4 business days after the appointment.)

I want to thank you for the positive support some of you left, it helped us get by!

There is no appeal, so this is a dead path.

Congratulations!!! I'm glad you didn't give up even despite the overwhelming feedback (most responders have well-meaning intentions, though, it's fairly easy to determine which ones they are from the wording of their posts). I just love it when an underdog comes out on top! :)
