My fiance is coming this month and we are trying to get married by the end of Dec. Would I claim him on my tax return?

Unless you have a ITIN for him you will have to file Married filing separate. If you get the ITIN you can file Married filing jointly. (that makes a difference in the refund if one is given).

I did my 2011 taxes and did Married filing separate.

Exactly correct, and this is exactly what we did. Married in December 28th, less than a week after she arrived in the US. About two weeks after she arrived we went to the Social Security office and applied for her SSN. We filed a joint return for that year.

One issue - Because my wife had never filed a tax return in the US before, she had no previous year's AGI on which to base a request for a PIN so that we could file electronically. We had to file a paper return.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

the only 'rule' here is married before midnight, 31 dec 2012.

do that? can file 'married filing jointly' in 2012 tax year.

don't forget to get the ssn a few weeks after POE date.

Debbie - the OP is coming in on a K-1 visa, not need to pursue ITIN at all. beneficiary will have a SSN before the tax filing deadline date, if they walk into a SSA office 2 to 3 weeks after POE.

Just out of curiousity, because I've never filed American taxes before... does filing jointly make a HUGE difference?

We're planning on getting married on January 1, 2013... but would it save us a huge amount of money to switch that to December 31, 2012?

Around $3K I believe. Though, the comparison might be different if he already gets a lot of his taxes back for whatever reason (it is possible to max out in other words... If he only paid $1 in taxes he won't get $3K back, he'd have to pay that much to get it back).

You can always do mock tax returns both ways and calculate what the difference is.
