Hello Everyone,

I am going to have to fill out packet three pretty soon, and I had a question regarding police records.

My husband was residing iligally in Germany for about 2 years and when we applied for the I-130 the lady in the embassy said that my husband was going to be asked for police records later on. Now we are going to have to fill out the packet three. The only record that my husband has from germany is a letter from court stating that he is ok however is not allowed to step in certain countries... like italy, germany vienna and so on without a visa and that he was judged for this by the court and returned to albania .

My question is: is this court letter enough? if not what else can my husband do ?

You need a Police report from all countries you have resided in for over 12 months since the age of 16 (or over six months if it is your country of citizenship or the country you are currently living in.) So he will need a police report from Germany.

I'm afraid I do not know about how to obtain a Police Report from Germany when you are not resident here, but I can confirm it is possible to get a German Police Report when you are not officially resident here (although I am not 'illegal', I am not a resident of Germany and was able to get the Police Report very easily by applying at my local Rathaus.)

Thank you Twood2k and Candance for your replies. Unfortunately Candance my husband right now is living in Albania since we applied for the I-130 a year ago. And as I mention he was iligally in Germany....he was sent back to albania since being without papers and was given a court letter stating he was iligal in germany and that's all. My husband keeps saying to me that he cannot get a police report from germany since he was iligal there and doesn't know how to get a police report now from Germany. I hope they will just accept the court letter.

I encourage you to be a bit more forceful on this. I do not think a court letter is going to suffice.

If your husband can't/won't figure out how to get a German certificate from outside Germany, maybe some other VJers will help you.

The instructions are likely on the web, if you put some muscle behind searching.

Why would your opinion be opposite of what the instructions say?

The police cehck is required of everyone living outside their own country for a year or more.

meauxna i have searched and read every post and you are right most of them do say that police records are needed, and of course it is required from all countries but my husband keeps insisting that he cannot obtain one :angry: and is driving me crazy..

Former residents of Germany, no longer registered in Germany, can apply for an individual record through the German Embassy or Consulate in their country of residence, or directly with the Bundeszentralregister in Bonn. The application form is available at the German Embassy/Consulate, or directly from the Bundeszentralregister, Auslandsabteilung, Heinemannstrasse 6, 53175 Bonn. Telephone: 01888-58443. Fee: 13 EURO. Processing time - minimum of three to four weeks.

It does say "registered" but a phone call may be in order

Not too long ago there was a lady here in VJ whose husband had stayed in (if I remember correctly) Italy illegaly and was able to obtain a police certificate from Italy...

2001 - met in Germany

April 2003 - fell in love

Aug 2004 - go to the US for internship

Feb 2005 - both return to Germany

Aug 2006 - getting married

DCF timeline:

09/01/2006 - filed the petition in Frankfurt

09/06/2006 - medical in Frankfurt

09/26/2006 - faxed checklist

10/05/2006 - received interview invite

11/01/2006 - INTERVIEW in Frankfurt - approved!

Thank you everyone for your help...I did call the embassy after trying for 1 hour I was finally able to talk to them, the lady told me that police records are needed and the court letter would not be enough. She told me my husband should go to the germany embassy and request them from there. Thanks again guys for everything.
