Hello VJ community! :)

I'm a newbie here, wish I'd found this forum earlier! All of you are doing a fantastic job!

My question is, What if someone like me did not send any photographs/joint bank acc/insurance documents with their AOS application? My lawyer applied on our behalf, and he never spoke about any additional evidence required to prove that the relationship is bona fide( Among the other things that he never mentioned :unsure: ). He'd said that we would only require additional stuff at the time of the interview. :bonk:

What if you just sent a plain boring application, with the forms(I-130, I-485 and I-765) and a marriage certificate? Is there anything you can do later? It almost seems like an irony because we do have plenty of evidence- photos/joint bank accounts/leases on our names,as we lived together for 2 years before marriage.

I already have my fingerprinting scheduled for 12/18. Should I be worried? Any advice/suggestions,please? :help:

Seems there are two things that can happen.First they will notify you of your interview date and then you bring all your stuff with you. Or they will issue an RFE for more docs and you send all the stuff to them. Then they issue you an interview date and you bring all your stuff again.

If you submitted no information whatsoever then it's possible you will receive a straight denial for not following the form's instructions (I-130 instructions clearly state to include proof of financial co-mingling, birth certificates of children born to both parents, affidavits, etc.).

Alternatively you might receive an RFE for these documents, asking you to prove the bona fides of the marriage.

It's also possible they will simply wait until the interview and ask you to provide supporting documentation of the marriage then.

Yeah, you're probably right. RFE is what I'm hoping I don't receive.

So far however, I've only received NOA for I-130 and my biometrics notice for 12/18.

I didn't receive NOA for I-485, I-765 etc either, and I hope it is not because of unsent docs.

Also, I have a MSC receipt number which is not showing my case online.

I submitted no affidavits/proof of financial co-mingling, but the marriage certificate(got married on 10/24).Pretty stupid thing to do, now I realize. :blink:

I submitted no affidavits/proof of financial co-mingling, but the marriage certificate(got married on 10/24).Pretty stupid thing to do, now I realize. :blink:

I just had a powerout in the entire house in the middle of responding so here we go again..

Proof of comingling is usually brought to the interview. The I864 and supporting evidence is crucial - just as crucial as the marriage certificate and proof of legal entry(copy of I94 or depending on the visa your spouse used to enter the US with).

Either the case will be denied based on the amount of initial evidence that's missing, or you'll get a pretty extensive RFE. I'd suggest starting to gather the missing documents regardless of the outcome - you'll need it either way. And if your spouse hasn't already had a medical, arrange one of those with a civil surgeon(to be found on USCIS's webpage).

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Gather everything up for the interview! If they need anything they will contact you. Did you sent passport pictures or affidavit of support?

I sent passport pictures and affidavit of support. Also sent the marriage certificate. But, no supporting docs. Thought hiring a lawyer would ease our problems, apparently it did the opposite. :huh:

You are right about gathering up.I digress here- But along with the documents, I better get my husband involved rightaway. His memory seems to be on a permanent vacation when it comes to remembering anything other than the Xbox. :rofl: Not the best thing to happen when you have a life changing interview, with a slightly irresponsible lawyer and zero paperwork.

Anyway, :ot2: my question is what do I do now?

Sorry if I failed to clarify earlier, but I(my lawyer) sent the I-864 and the medical. I just did not send any additional affidavits of third parties proving a bona-fide relationship/supporting evidence like photos, bank statements,lease- like you said, it's mentioned in I-130. I'm the non-citizen spouse, my husband is the USC.

So, in other words, supporting evidence is missing from my file.

Ok, not a problem! Just giving my opinon I'm sure if I am wrong somebody will correct me!

Gather up;

Lease or house payments in both your names,

Tax returns,

Bank statements,

Car insurance,

Health insurance,

Life insurance,

Bills in both your names,

Pretty much anything, that shows your life together!

Oh and birth certificates, passport entry stamps, pictures...

I don't think you have to practice for the interview, just remind each other of the things your done together, what you expirienced and how far you come together!

It's actually kind of fun!

Ok.

Photos and affidavits are good to establish the "love is in the air" bona fide relationship whereas joint accounts and financial comingling is the other aspect of a bona fide relationsip/marriage, from agencies that have no personal interest in your immigration journey, and that are easily trusted . There are many examples on VJ to what kind of evidence.

Always send copies of the evidence, bring the originals to the interview.

Mail what you have over to the USCIS ASAP. Attach a cover letter explaining that you left the items out initially. It may get added to your file. It might not.

06/2011 - Moved to Minneapolis, MN
