Timeline

We put in our I30 2 weeks ago and had received the NOA1.

I am visiting my husband under the VWP program, ie I am in the USA now. I have received a job offer in the USA. However, I have some questions on the visa:

1) Does the hiring company has to apply for a H1B visa and then I submit a form to change the status

or

2) I can submit a change of status directly without the hiring company applying for a H1 visa?

You cannot work on VWP so that mean either the company will have to file H1 for you or you can work when your CR1 is approved until than you cannot work.

If the company wants to file H1 for you that means you would not be able to start working for that company until Oct 2013 (unless the company is exempt from visa quota)

I am guess your CR1 would be approved by Oct 2013 anyways… as it would be close to 10 months from application.

So what I mean to say is there is no way you can just start working for the company right away.
