I sent out my request for tax transcripts a few weeks ago and stupidly, did not request 2009 as I had expected at the time that I would have 2012 by approval time.

Now, if things progress as they have been, let's say I get approval in early february, I could very well have my tax return done, but not necessarily refunded or completed in the IRS system in time to then send out for the transcript.

The instructions state to provide either a photocopy or transcript of my federal tax return so am I correct in assuming I may just print out a copy of my 2012 1040ez and perhaps a copy of my W2 along with it?

I will be requesting the 2009 transcript as well as a backup, but given my traveling circumstances over the next few months, I'm afraid it may get misplaced and not find its way into my possession as it should.

There is no perhaps, if you print out a copy of your 2012 1040EZ form for submission with your I-864 package, you must also include a copy of the appropriate W2 form.

Copies of W2's are needed when submitting copies of tax return forms; they are not needed when submitting transcripts.

Without the "perhaps". A complete tax return includes W2 and 1099 forms.

I understand that until taxes are due (april) nvc doesn´t ask for the current year tax returns. so if you are ready in february, they still won´t be asking for them. is this correct?

They won't require it as the current tax year, but if I have it, I'd rather use that one over 2011/2010/2009

They can ask for anything they want but probably won't require the 2012 tax return in February. However, it is always wise to bring updated evidence of the sponsor's current income to the interview. A copy of a recent pay stub will usually do nicely for that.

I just know I don't meet the min requirements in 2009 and 2010 so I'd like to file with 2012. If 2009 doesn't get lost on the way to me then I'll submit all 4 to be safe.

Not to mention by the time interview comes then 2012 may be the recent tax year so might as well head them off and send it in ahead of time.
