Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Who files really only matters if the marriage was reported to the local Philippines consulate. She will also need to apply to the Philippines courts to get the divorce recognized as legal in the jurisdiction it was given, and then turn that court document in the NSO so her CENOMAR can be amended. To get the divorce recognized, she'll need the complete divorce papers and copies of local divorce law. The court will look this all over to insure the divorce was properly given.

So what is the process if the relationship isn't working and she wants to go back? We are scheduled for biometrics this thursday and she doesnt want to go. If we determine she want s to go back can USCIS send her and daughter home if we drop the process? :bonk:

At this point, if you drop the process, your wife and her daughter eventually will have to leave the U.S. However, the USCIS will not pay for any of their expenses.

Yes, they can send them home as they will have no right to stay. They should leave voluntarily - the USCIS obviously won't pay for it, but voluntary departure without illegal presence will have no consequences for them immigration wise. The only way Homeland Security will pay their ticket home is if they stay illegally, refuse to leave and are arrested, detained and forced home. This is not a pretty way to end it.

Uscis will not send her back, the cost of that is on you/ her.
