Questions about AOS I-485 processings....

hello and good day to all...

i have a number of questions concerning processing papers for AOS for my husband.

* I-485 ( PART 1 - ASKS FOR I-94 #....Where is this located? )

- I-485 ( ARE WE BOTH REQUIRED TO FILL OUT BIOGRAPHIC DATA FORMS? )

* I-864 Affidavit Of Support: ( i will explain my situation so as to make it easier to answer......I do not qualify to be sponsor, i am under 125% pov. level and we have a baby girl, which would mean im supporting 3 persons. I am not working and have not been since ive been pregnant (baby 7 mnths old) . My grandfather was the co sponsor for our I-129f petition and will be the Co-Sponsor for the AOS. He definitely qualifies to be sponsor, more than enough. He does not live with us.

So here are my questions regarding filling out "MY" I-1864:"

- PART 3: (8 : i am sponsoring the principal immigrant named in part 2 ........DO I CHECK YES OR NO? next to "NO" says ( applicable only in cases with two joiny sponsors.....) ???

- PART 5: HOUSEHOLD SIZE: says enter number of persons you are sponsoring "1" my husband.......ok....then ( C. ) says if you are currently married (yes...we are married) enter "1" for your spouse.....DO I LEAVE THIS BLANK ? IT SAYS DO NOT COUNT ANYONE TWICE.

BEINGS I DO NOT QUALIFY TO BE SPONSOR DO I NEED TO PROVIDE BANK STATEMENTS, BANK LETTER, PROOF OF NOT FILLING TAXES (below level), ? I AM PROVIDING AN SUPPLEMENTARY EXTENSIVE LETTER WITH I-864 EXPLAINING MY SITUATION, WHY HAVE NOT FILLED TAXES, AM UN-EMPLOYED ETC.

I HEARD THAT IF I-131 APP FOR TRAVEL DOC & I-765 EMPLY. AUTH. WERE FILLED WITH FORM I-485 AOS THEN THE FEES WERE WAIVED? (normally the cost) IS THIS TRUE?

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Only your husband is applying for AOS. All the forms are filled out by your husband, except the I-864, which is the only form the USC needs to fill out. See the guide: http://www.visajourney.com/content/k1k3aos and example forms: http://www.visajourney.com/content/examples

Yes. You are not using more than 1 joint sponsor.

- PART 5: HOUSEHOLD SIZE: says enter number of persons you are sponsoring "1" my husband.......ok....then ( C. ) says if you are currently married (yes...we are married) enter "1" for your spouse.....DO I LEAVE THIS BLANK ? IT SAYS DO NOT COUNT ANYONE TWICE.

You do as it says and not count anyone twice. The person you are sponsoring is your husband. The form also states "persons NOT sponsored in this affidavit" You would put 0 for c. If your joint sponsor is married, then he would put a 1 there as his spouse is not the intending immigrant counted in a.

You need to fill out your own I-864 and provide your most recent tax transcript or a letter stating why you were not legally required to file taxes for any or all of the last 3 years. Your joint sponsor fills out their own I-864 and provides their most recent tax transcript, letter from employer and most recent pay stub(s) or other documents that prove their current income. They also need to include proof of being a USC or LPR. I suggest reading the I-864 instructions.

I HEARD THAT IF I-131 APP FOR TRAVEL DOC & I-765 EMPLY. AUTH. WERE FILLED WITH FORM I-485 AOS THEN THE FEES WERE WAIVED? (normally the cost) IS THIS TRUE?

The fees for the I-765 and I-131 are waived when filed with a pending I-485. The total for AOS is $1070 with or without those 2 forms.
