Hi Everyone,

I have been spending alot of time on this trying to find the quickest method of bringing my fiance to the USA. There is a great amount of info, some of which contradicts the US state pages. (That I can only assume reflect current regulations)

What is the quickest method of obtaining a visa for my fiance to enter and stay in the USA? Please note, I am able to travel to Japan and marry there, or bring her on tourist visa and marry here, my options are open, just looking for most efficient route.

There are many variables associated with going with the fiancé(e) or spousal visa process that can affect the time frame of each process. Take a look at the Quick Comparisons, located in the "Guides" section, accessible at the top of the forum page, for a ballpark estimate. The spousal visa may be a bit quicker, however, YMMV. :thumbs:

Hi, thanks for reply. That is part of my confusion, the K-3 option looks best, but there have been some posts saying that K-3 has become obsolete. May my fiance come to US and marry and then file for the CR1? What is the real difference between K-3 and CR1?

K3 is a non-immigrant visa spousal visa that would require the holder to eventually go through the Adjustment of Status Process in order to obtain a green card. CR-1 is an immigrant spousal visa; it's holders are given green cards on arrival (the visa in combination with a CBP entry stamp acts as a temporary green card, the actual card arrive in the mail a few weeks after arrival).

The K3 is obsolete because it is often administratively closed by the NVC.

To the point of your original question. You can start the K1 process now (as long as you have met at least once withing the past two years). You will not be able to start the spousal visa process until after you are in possession of a marriage certificate. The K1 process allows her to come, you two get married, and then she files for Adjustment of Status.

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If speed is the most important, and you have met in person in the last two years, then the K1 is a few weeks faster (but more expensive, and she cannot work/ travel for a few months after she gets here).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I applied for a visitors visa to go and see my fiance but i was denied, reason being that i did not have enough grounds to warrant my return (Of course i have a permanent job, which i have had for three years, i guess it wasn't enough) My fiance couldn't afford to visit anymore so we filed for a K-1. We are three months on and still waiting for NOA2. All the best in your Visa journey, you can try the K-1 if you are not able to marry your fiance immediately.
