I am Venezuelan and I won the Green Card Lottery. On April 2012 I moved to Miami, Florida and now I have my full Green Card, SS Card and all.

I am planning to go to Venezuela and get married with my girlfriend and come back to Miami to start all the paperwork to bring her to USA.

Now, I been reading a lot and I’m not clear of how is all the process.

Some information says that when I come back to Miami, I have to file the form I-130 and once that is approved and a visa is available it will be sent for consular processing and the consulate or embassy will provide notification and processing information. This case is because she is living in Venezuela. In some places it says that this process could take 3 to 7 years.

But also, if she is inside of USA I have to File Form I-130. After a visa number becomes available, apply to adjust status to permanent residency using Form I-485 in order to adjust status.

And this is my confusion. She has a tourist visa and she can be here for 6 months. Can she come to USA with me with her tourist visa and once we are here I file the from I-130 and the I-485 and request an adjustment of status.

What would be the best and fastest way of doing this.?

Marry your girlfriend in Venezuela then go back to US and file i-130 for your wife.

Wife stays in Venezuela until she gets her visa. She will be under the F2A category (Spouse of LPR). Waiting time is at least 2 YEARS. That's the safest route.

You can come visit her in Venezuela as often as you want.

The entire process takes 2-3 years.

But also, if she is inside of USA I have to File Form I-130. After a visa number becomes available, apply to adjust status to permanent residency using Form I-485 in order to adjust status. It takes 2 years for a visa number to become available to her. She can't wait in the US for 2 years with a tourist visa. She can apply to adjust if you petition for her, wait two years when a visa number becomes available to her, and if she is in the US at that time, she can apply to adjust. She can't adjust before a visa number becomes available (which is 2 years after you apply).

And this is my confusion. She has a tourist visa and she can be here for 6 months. Can she come to USA with me with her tourist visa and once we are here I file the from I-130 and the I-485 and request an adjustment of status. NO. THIS IS VISA FRAUD. SHE CANNOT USE A NON-IMMIGRANT VISA TO ENTER THE US WITH THE INTENTION TO IMMIGRATE. THAT'S FRAUD!!!!!!!

The fastest way will take 2 years.

It takes 6-12 months to approve the I-130. (This is the basis of your 3-7 months). However, approval of the I-130 is only the first step. Your wife would need to wait for an available visa number after her I-130 is approved. The overall wait is 2 years.

She cannot adjust status until a visa number becomes available to her. If she applies to adjust before a visa number is available, she will be denied. It will take 2 years for a visa number to become available to her.

i would suggest u to apply for her visit visa first as she wud be with u and then apply for green card bcoz once u applied for i130 u wont be able to get visit visa n it will be ordeal time for u both
