so fix the 2011 and 2010 returns this week, via filing TWO 1040Xs with the W-7.

Ok I will try my best on doing that, sorry I made a mistake we are married on October 2011 not 2010 so it's only 2011 return that need to be fixed. But what if we could not make it at the right time, could we still be able to fix it after 2012 ends or I may submit it as it is as anyway it is not the one that we are going to use as last year return.

So can file a 1040X for 2010.

you also have problem with 2011, so file a 1040X for 2011

Prep all, submit all, together, WITH the W-7 and the documentation on yer ID (read the w-7 instructions, nowish, aye? )

hi! I was reading about the post regarding taxes and I got confused with our situation. as I mentioned last week we're already case complete and currently waiting for interview date. And im always reading updates here so I'm informed and aware of things.

I have a question too. I'm not familiar with tax procedures and terms that's why it's confusing for me. We got married march 2012 and I think my husband filed his 2011 tax around April 2012 but as single. My question is, should he be filing as married last April 2012 for 2011 tax returns since we got married march 2012 or its okay to file as single since its for 2011 tax returns? (Sorry I really have no idea with taxes) I just thought its all good since we didn't get rfe for aos and we're already case complete. Will I have a problem in embassy coz of it? thank you guys and happy holidays! :)

No, he did it correctly as he wasn't married in 2011. But for 2012 taxes, he'll have to file as married, not single.

Yes, if you sign up for EP (you need to optin), then yes, you scan everything in both packages, email each package in one PDF, and then bring the originals to the interview. You should look at the wiki I wrote about the NVC process in relation to EP and online forms. Then send the link to your lawyer/lawyer's clerk.

If you can't find out the dates, then you obviously can't fill it out. It shouldn't be a big deal. I've never seen someone get a checklist for NOT putting all the information (as they can't remember). The employment section is not the most important part of the form (unless you worked as a prostitute or something, which then it would cause problems).

It's probably just a delayed false checklist from when your AOS package was reviewed. NVC is still open for another hour by the way ;)

If he's married, he CANNOT file as single. You have 2-3 choices: married filing jointly, married filing separately, or head of household (certain conditions must be met for this one). The foreign spouse doesn't need a SSN to file together. You'll apply for an ITIN at the time of filing. This is what I did with my husband for 2011 (tax year 2010). He filled out a 1040, I filled out a W7, then sent it in to the ITIN department. They assigned me a number, then sent the package to the IRS to complete the tax work.

Thanks for clearing this up for me as well. In my case I am petitioning for my wife and two stepdaughters. Actually 3 petitions submitted at once. Would I get an ITIN for my daughters as well and file them as dependents? Thanks.

Expedite requests vary in length as its dependent upon the embassy. Some embassies reply quickly, others more slowly. It also depends on their workload and if there's holidays (like now). So, you can hear back this week, or next month. There's really no way of knowing. Just keep calling NVC once a day and inquiring about the status. Nothing you can really do at this point except for staying up to date through NVC.

First you need to figure out if they're dependents. The IRS has instructions for 2011 here: http://www.irs.gov/pub/irs-pdf/i1040.pdf (page 15). If they are qualified as dependents, then yes, an ITIN is required as there's a section on their SSNs.

I swear if this wasn't happening to me i wouldn't believe it.

The latest DS-230 Drama. ........My husband takes package to FedEx last friday the 21st they give waybill slip with tracking number and receipt and guarantee it will get to me Thursday 27th, TODAY. Well than it got weird cuz tracking number not in system friday even saturday. So my husband goes back to FedEx to find out what the hell is going on. They say system is down blah blah but they assure him package is on its way and they will have it in system monday. I by this point don't get it think this is a bad "You've been Punked" episode. Even thought bad thoughts of my husband, shhhh don't tell him. This visa journey will make you look sideways too.:blink:

So me and husband all day today been in pray and he was on phone less than 15 minutes ago with our pastor. I just checked the FedEx site for the tracking and guess what the package just got picked up in Lagos at 6:34am. I am thrilled and pissed. Thrilled that I finally get to track our package after 3 attempts (Since 9/10 people we been trying to get this to me). But pissed because it won't get to me until January 2nd. Which I am sure will make Case complete who knows and probably a March interview oh well. The documents are coming to me people. So I am grateful. Oh joy.:dance::dance::dance:

LOL! at least you are being honest and taking all these in stride. I would feel the same way too , three attempts?!!!!!. Thank God the battle is won and the first step taken to get it out to you byFedEx.

USCIS approved case 12/17. called NVC yesterday and lady said they received file 12/20 but yet to enter it into their system and to give them 15 business days. will be calling again tonight :)

so sureal to be back here after a year :). When I was doing it for my mom, it went very smoothly mostly by solo research on VJ links and NVC site but for a spouse, you do not want anything to go wrong and cause more delay....so i think I have selective amnesia about this whole process.

Read your review! Couldn't believe the interrogation that some people had to go through at the airport blink.gif Glad you weren't one of those though and were able to make your connecting flight!

And by the way, got chills at the very end where you wrote your wife came to greet you and said 'Welcome to America'. Finally, another happy ending :)

No faxing, no emailing. It needs to be the originals or certified copies. It can't be copies of any sort.

Well yesterday was the re-scheduled interview at Caracas Embassy. Because of the Christmas holiday was not the normal staff. Everything was very calm. The ONLY interview scheduled was ours. Very easy, people were really nice. No hard questions, very routine but always with a good attitude. Interview was approved, but with so little drama.

Embassy officer offered to expidite VISA in a couple days, and said he would begin working on it immediately.

can i fax my original civil documents, or scan & mail to my spouse in USA...can he use them to send to NVC (print one). Or is it must for me to courier originals to him. Please let me know

It is a must for you to courier originals to him. Whilst yer prepping those, are you certain you have sent a DS-230 to your husband with your original signature? if you missed that, as well, you might as well prep a new ds-230.
