NVC Filers - December 2012

yesterday I the NVC and ask about my case if the DS-230 and AOS was accepted or not so the one who answered told me that our case is completed and now waiting for interview date so we were so happy then someone called my mom who is our agent and told her that he gave us the wrong information about the case and our case is not complete yet and probably will take up to 20 business day so I called back and the same person answered he told me that he gave me the wrong information ans asked if I want to discuss it with a supervisor and I said "Sure" so the supervisor told me that our case is not completed yet and she said something about our case is now at the DOS waiting for our originals to be reviewed or received and I have to let them more time and she said that our AOS is fine, I'm not gonna tell how much frustrating it was but I want to ask is it NORMAL that my case is at the DOS now waiting for my originals? wasn't it supposed to be at the NVC now still? I'm a little confused and need some help

I'd call up again next week and inquire. Not sure what they're talking about...

Plane leaves in 11 hours and 30ish minutes.

So we're working on the AOS, and I have a question about proving domicile being my wife has been living abroad with me for the last 3 and a half years. My wife's bank account in the states has been inactive for the last 4 years so we don't even know if it still exists and we haven't gotten around to checking yet. She did not own a credit card. She does have voters registration number(and we are also looking into how to obtain proof of voting in the 2012 elections), SSN(including proof of name change through SS once we got married - I mean if she wasn't intending on coming back why bother changing her name on that and her passport right?), we don't have kids together yet so can't do the school thing, I am going to show a moving company and health insurance quote though, and we have a letter from her daughter(who is also our joint sponsor) that we will be living with her. Besides that just phone calls made to the states in recent years(like over 2,000 of them) and the stamps on the passport with visits to the states, it doesn't show domicile but does show strong ties. Do you think all that will be enough, if not are there any other ideas? We will also look into opening an account online if possible. Another thing I thought about is she still has plenty of her things in the states, that she left there when she moved here. Is there a way you can think of to prove that? That way it would be obvious she was and is intending to come back being most of her belongings are still there. They're not in storage but in her daughter's basement, so can't show like a storage receipt or something...any ideas?

there are two paths on this:

1. showing evidence of USA Domicile or

2. showing evidence of re-establishing USA domicile.

Pick one or the other, aye? Don't try to do both, you'll fall over as if running with shoes having tied shoelaces.

Ultimately, this evidence is shown on interview day, so if you don't have it now whilst prepping the AOS package for NVC, don't fret too much - just remember SHE MUST HAVE that evidence by interview day.

What happens if you don't call NVC?

You will be put into 'postal processing' mode at NVC, by NVC.

There's 3 things to handle at NVC - DS-3032, IV, and AOS.

That's 3 months per thing in postal processing mode, so figure 9 months minimum.

Postal Processing = NVC sends the petitioner and beneficiary stuff via postal mail, a telephone is never utilised.

Hello December fillers!

I must confess that the NVC step is still a little bit confusing for me.

I read all the post and guides I could find (especially on VJ) and I think that my next step is to start calling NVC 2 weeks after NOA2, that would be the last days of December, to ask for my NVC number so that I can send my "choice of agent" by email. Will my USCIS number (MSC number) be enough for them to locate my file?

What happens if you don't call NVC?

I already gathered all the other documents (marriage certificate, taxes, etc.) but I just know how to start it! :help:

Do this stuff on a PC, not a handphone. You miss 80 percent of stuff when using a handphone browser, and that's really, really bad, when trying to study up for NVC Document Processing.

Don't like that? Read again, click again, back at post #1. Take yer time, about a week, putting pen to paper, making copious notes.

Ok I've also got to prove domicile so I used the template provided in the first post and this is what I have:

Below you will find a list of attached documents to show that my principle residence is in the US and the steps that I have taken to return to the US with my family.

Steps I have taken to maintain US Domicile:

• Maintained my XXXX voter registration

• Maintained my bank account at XXXX Bank

• Maintained my Virginia drivers license

• Filed taxes with the state of Virginia

Supporting Documents for the above steps I have taken:

• Copy of Voter registration card showing permanent US address

• XXXX Bank statement showing permanent US address

• Virginia drivers license showing permanent US address

• Copy of my tax returns

Steps I have taken to return to the US to take up residence:

• Made arrangements for us to move in with my parents

• Contacted Fairfax County Public Schools for requirements of things to bring to register my children in school

• Contacted shipping company for estimate of costs to ship belongings

• Purchased one way air ticket, leaving on DATE

Supporting documents for the above steps I have taken:

• Lease agreement between my spouse and I with my parents

• Email from Fairfax County Public Schools regarding registration requirements as well as copies of all documents I have prepared so far

• Email from XXXX with estimate and correspondence regarding shipping our belongings

• Copy of our eticket

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

As per the template I didn't think that it was a problem to provide proof that you are re-establishing and also that you have kept up your domicile?

Also, as far as I understood, proving domicile is very consulate specific. IE the embassy in Montreal is really hard on that but the embassy here in Qatar isn't really.

Oriz I think with your evidence, if you HAVE to pick one or the other (which I don't think you do, as my letter shows above) then I would choose the re-establishing path as it seems that more of your evidence fits in with that scenario than with the proving domicile scenario.

I'm sure Nola will jump in her with a word of advice also soon...she's got her domicile letter/evidence ready too!

Ok thanks. But then again anyone can just ask for quotes and show them whether they plan to follow up on them or not. I'm looking for some more creative ideas, or, for someone with experience to tell me what I have is enough lol

Here's a hard and fast line that you might want to think about .

When you are maintaining a residence in the USA,

well, there's a lot of stuff:

1. lease in your name dating back from the time you left to USA to interview day

2. utility bills in your name dating back from the time you left to USA to interview day

3. deed in your name (if you own the house)

Don't have ANY of the above? Take the path to prove-up re-establishing domicile in the USA, instead.

Remember, this is free advice - get 10 more opinions, you choose, aye?

Based on what you've written, she has no USA Domicile.

She'll need, instead, to go the 'prove-up re-establishing of USA Domicile' route.

Remember, it has to be shown on interview, not needed prior - so she has some time. Not a lot - but enough.

Just wanted to let yinz know I'm now safely in Pittsburgh. Everything has gone extremely smooth - way above my expectations. My Christmas Eve today (which is when we start celebrating back home) has been nothing like Christmas in Sweden... but that's how I wanted it to be anyway. Mullin's diner for breakfast (the Hungry Man breakfast made me a very un-hungry man lol), we got julmust (Christmas-y soda pop) at IKEA, nice lil visit with the in-laws... Now drinking the julmust with choc chip cookies and WWE raw wrestling - Xmas eve in America! :)

Awwww how cute is this. Have an excellent Christmas. I am baking cookies for Santa (I have 4 grandkids) and well we have vegetables for the reindeer and cookies and brownies for Santa). Oh Holy Night indeed.

Only thing missing is my husband. But soon soon. have a great Holiday.
