No problem!

And waiting shouldn't delay your case that much, if you're worried. As the holidays are coming up, you probably won't get a case number till the very end of December or sometime in January (more likely). Then you have to wait for the AOS bill to be invoiced and paid. So depending on when he gets his W2s and gets the tax forms filled out and sent, it might only be a week or so delayed.

perhaps your approach on getting an ITIN is out of the norm?

I know a bit about filing taxes and using an ITIN -

here's what we did.

My wife went to the US Consulate in Chengdu, got a photocopy of her bio page of her passport notarized by a US Vice-Consul,

then signed the W-7 form and form 1040 - mailed it all back to me; I signed where needed, attached my w-2s and sent all off to the special ITIN address in Austin TX.

and that's how we filed taxes jointly, our first year. I don't understand your scenario, at all.

I only know of one way 'to apply for an ITIN' - and that's to submit the income tax return with form W-7 and all supporting docs to the special ITIN address in Austin, TX.

What are YOU doing, to obtain an ITIN for your spouse?

perhaps your approach on getting an ITIN is out of the norm?

Ok so i filed 2011 as single ( my mistake ) just assumed that my wife does not have a SSN # so filed single , later on found out that as wrong . Today after i asked my question i came home and her ITIN # in my mail box fom he IRS they said takes 6 weeks but it actuallytook me only 12 days . So the question is ... does this tax Amendment Effect Affidavit of support any how ?? Does it make any Difference at interview ? Thanks darnell

ok - i understand now.

this changes your AGI, line 22 of the 1040 (not sure what the 1040X line is)

so is your AGI on the 1040X above the 125 percent of the poverty line mark ? if so, yer golden...

So, if yer golden, submit a new I-864 on interview day with the 1040x and itin.

Ok let me try this again .. Here is my question .. Maybe Darnell or Saylin can help .

I need an advice please from someone who knows taxes very well .. I applied for an ITIN number for my wife after submitting I-864 . Would this be a problem at all at the interview for her , i know CO may ask for my 2013 tax return if it was done by the interview time , so i don't know if i should contact IRS and ask them to cancel the whole thing or just leave it as it is ? Help appreciated . I already got case complete and waiting on interview date , most likely it will be in FEB , NVC said JAN is full . Thanks

I had quick question concerning the medical -

if they find something that is not good are they obligated to inform you? or you have to wait until interview date to hear about it?

Unfortunately we were not approved although if we get another sponsor, we can just send that in and we should be all set.

I don't quite get how the AOS can be approved but for the embassy to say no.

No actual questions were asked... We just had a 3 hour wait and then a 5 minute conversation for swearing to the truth and then mentioning the sponsorship.

The guy was new (he kept yelling back to another guy with questions like "Do they have to sign anything?") and insisted that under no circumstances can the USC be a sponsor if they live with the petitioner abroad. He didn't accept Intent for Domicile (not based on the evidence but in any case) and despite my letter from my work on continued employment at many many times the poverty level.

I'm sure I could fight it but I'm just going to try for the additional sponsor and get it sorted.

I hate the inconsistency but I suppose that is what it is all about.

One question about the above.

The guy mentioned to my wife that she "shouldn't send in the turbo tax type one - use the other one" without mentioning any actual forms. I really don't know what that means. Could he be referring to using the I-864 instead of the I-864a?

I am nearly sure we should be using the I-864 anyway.

Just because you were approved at NVC, does NOT mean your income will be approved at the embassy since they have their own "rules" about what kind of income you need. Now, this could have just been because the guy was new. But it'd go a lot faster if you just found a sponsor.

I believe he's referring to 1040s and not any forms from an online tax software.
