hello! my husband had his appointment yesterday 11/28/2012 in tegucigalpa, honduras. he first entered the Us in 2001 but gotdeported in 2004. in 2005 he entered again ilegally and left the US voluntarily in 2/2011. when he went to his appointment they asked him if he had entered the US after his deportation and he said yes. They told him he has to wait until he completes his 10 year ban before applying again. They told him he did not have the opportunity to submit a waiver. What can I do? Can we submit waiver 601 and 212 eventhough they said no???? i am a US citizen and have 3 children with him. we been married for almost 10 years.. I feel so disapointed! don't want to live in honduras for 10 years! someone please give me an advice of what we can do next. Thanks so much.

Hold on, you've been married for 10 years and yet he got deported in 2004 and he voluntarily left in 2011? Is there a reason (s) why you didn't file for him immediately after getting married 10 years ago? You could try submitting the waiver, but it sounds like you'll have to go with plan B: live in Honduras or another country for 10 years.

Don't ever do anything you're not willing to explain the paramedics.

exactly, 10years ago is 2002; one year after his first entry. You could try to submit the waiver under hardship since you hav three kids together but honestly laws are laws especially such strict immigration laws about consequences, they are put in place to keep us in check so you live some of the years in Honduras and visit for the rest.

01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!

I'm not an expert but he might not be eligible for the waiver because he entered without inspection after a deportation. I'm sorry but you might not have a choice in regards to U.S. immigration except to wait out the 10 year ban.

Best to post your question over at immigrate2us.net It is a similar forum to here except most of the members are dealing with bans and filing waivers and they can give you better information.

really weird cause they told me in my first interview if i got deported and i say yes the lady says i might file a waiver for deportetion and i remember exactly she asked me if ive been deported twice that way i can file 3 waivers im very sure she saids da i guess you better find a lawyer

hi

you shouldn't have filed until the 10 year ban was over, since he had a 10 year ban for overstaying, and left so the ban was in place when he entered the country for a second time

if he had stayed in his country you could have filed for him and he could have applied for a waiver, but as he entered the second time and got deported, there is no waiver possible

now you have to wait until the 10 year ban is over you can file for him
