Hi! I'm Currently waiting for my parents I-130 approval, hopefully by the end of this month.

I just wanna ask questions in advance to make sure everything goes smoothly during the process. About the I-864, specifically in Part 3, #9..

I have a sister below 21 yrs old..my question is, should either of my parents bring her with them once their petition gets approved? Do I have to answer YES in

#9 right? If so, will there be any information/docs needed for my sister? Also, my husband(household member) will be co sponsor since I only work Part time.

I would really appreciate your help to enlighten me. Thank you in advance!

As far as your Sister is concerned it sounds like you have not petitioned her.

If subsequently your Parents wish to then that would be on their shoulders.

No, your parents cannot bring your sister with them. A separate i-130 should be filed for each immediate relative of a US Citizen.

If you file a petition for your sister, your sister will be under the F4 category (Brothers and Sisters of Adult U.S. Citizens). Waiting time is 23+ YEARS.

One of your parents can file a petition for your sister once they receive their Green Card. Your sister will be under the F2A category (Spouses and Children of Permanent Residents). Waiting time is 2+ YEARS, provided she stays single/unmarried and doesn't age out during the entire process. If she ages out, she will be transferred to the F2B category (Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents) with a waiting time of 10+ YEARS. She will have to maintain single/unmarried status to be retained under F2B.

as said, your sister is not a derivative on your parent's petition, she was not petitioned. siblings are petitioned separatly.

so yes on each i864 for #8 and no for #9 as each parent has been filed separatly and will need an i864 and no derivative family members are immigrating with them.

your husband will need to file an i864A for each parent as your co sponsor
