Good afternoon,

1st post here, so hope someone has come up against this problem. My wife(USC) and myself ( Irish Citizen ) started the Visa process in July.

To date we have submitted the I-130 and had the petition approved by the USCIS and we were informed that it had then passed to the NVC for further processing.

The NVC have subsequently requested the DS-3032 Form which has been signed and filed. We have now received a request for the AOS processing fee ( $88 ) and also the Immigrant Visa Application Processing Fee request ($230) Having read a lot on the forums and on the US.gov website it appears that the AOS has to be filed while my wife is "Domiciled" in the US.

Our current situation ( we both live and work in Ireland ) prevents this. I have submitted multiple requests for clarification from both the NVC and the USCIS and we are getting nowhere.

The last correspondence suggested that we contact the consulate/embassy in Ireland. I tried to do this via the phone and via email and was in no uncertain terms advised that "We do not handle any Visa queries via this office - please direct your queries to the NVC. I have since mailed the NVC and been told once again to contact the Consulate.

We are surely not the 1st couple who are living in Ireland ( or any foreign country for that matter ) and are trying to get the Visa to allow us both to travel and work in the US??

Can anyone who may have been through this already advise on where we should go from here? We are happy to pay the relevant fees, but if this is going to cause problems with the application I would much rather identify a work-around or a solution before we head down the wrong road completely.

We were in the same situation at the same embassy :)

She needs to be domiciled OR show intent to re-establish domicile at the same time you immigrate to the USA. The way we did this is by buying a house in the USA, in joint names, where we intended to live (this also went towards the asset portion of financial sponsorship). Other options may be evidence that she is looking for work over there, enrolling any kids you have in schools in the US, that sort of thing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
