CR1 denied for a mistake in the marriage contract

Hi everyone,

It s with a heavy heart that I am seeking your help today. My sister just got denied this morning in Casablanca for a reason that I completely understand.

Her husband is divorced but on their Moroccan marriage certificate he is mentioned as single. the story behind this is too long to describe in a post.

Anyways my question is, what s next now? is anyone ever had a similar situation or anything close? does her husband need to travel back to Casablanca and get a new certificate? what should we do now? she s completely lost and I don't know how I can help :crying:

It seems very straight forward to me that they would need to do whatever is required to get the paperwork corrected and then present it again. Was she not given instructions?

It seems very straight forward to me that they would need to do whatever is required to get the paperwork corrected and then present it again. Was she not given instructions?

This. But also, did she get denied or told to come back with documentation? Ie when they gave her a piece of paper,w hat EXACTLY was written on it? Did they give her her passport back and if so, anything written there?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am away so didn't really get to see exactly what they gave her back but from our phone conversation she said she has her passport back, she gave her a red paper and another one explaining the fact that the denial is because the marriage certificate is stating he s single while he was actually divorced.

apparently they said she should get a "correct" certificate and give it to the reception at the embassy and that s what confused me. does it mean she will have to start the process over from square one or once she get a new certificate she will get assigned an interview date?

It all depends what the 221g states, it will say if the case is being sent back to USCIS or if she needs to present the correct documents.

I just asked her to scan and email me the paper they gave her. I am living in VA so that will give me a more clear idea of the situation.

I had the same issue. But I had to remarry my wife because the first act of marriage has single on it when I was divorced.However, your sister situation is different because they need to go back and remarry to get a new act of marriage that shows he is actually divorced.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I am so sorry to hear that. But, as long as they asked her to bring the correct marriage certificate, I dont see any problem but it is just a matter of time.

I am expecting my wife to be interviewed around end of January in Casablanca.

Please can you find out what was the interview about and what are questions she was asked and if they allowed her to keep all the supporting documents to the interview room......

It depends on the actual circumstances. If all the other paperwork correctly states he was married before, then a corrected certificate will probably do the trick. If he concealed the prior marriage from her and left it off the forms, that's an entirely different matter. You said it was too complicated to explain here. Without knowing what's so complicated about it, we really can't advise you reliably.

It depends on the actual circumstances. If all the other paperwork correctly states he was married before, then a corrected certificate will probably do the trick. If he concealed the prior marriage from her and left it off the forms, that's an entirely different matter. You said it was too complicated to explain here. Without knowing what's so complicated about it, we really can't advise you reliably.

In my case, I have a little bit similar case to the above one, I am expecting my wife to be interviewed at CO in Casablanca around end of January. i have two divorce cases and both divorce cases are listed on my all US papers and my wife is aware of it too and even knows their names. After reading above Rajaahope's sister case, I went through the copy of my Moroccan marraige certificate and found out that my latest divorce ( back in 2006) only was mentioned on it and my very old divorce ( in year 2003) was not mentioned on it. My question is if all my US papers are showing my two ex-wifes names and final divorce decrees ( already submitted to the USCIS), will the US consulate in Casablanca take it seriuosly and deny petition though Morocan marriage certificate shows my latest divorce and divorcee's name?
