Hello all,

Congratulations!

From the VJ K-1 Flowchart:

"*If your interview (and specifically the approval) occurs within 2 years of your marriage you will be granted a conditional permanent residency (2 year validity). If this happens you will have to apply to lift conditions 90 days prior to your 2 year green card expiring. If you are 'adjusted' greater than 2 years after you were married you should receive a normal 10 year green card."

Here is a USCIS calculator that may be of use to you:

Happy trails on your immigration journey.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Thank you.

What form will I need to submit, 90 days prior to our 2nd wedding anniversary.

Once they remove the condition, what status does that leave me with?

Take a look at the Guides section, found at the top of the forum page. In there, review the section:

Removing Conditions On Permanent Residency

Just like us, you have a 21 month reprieve from USCIS, enjoy your new lives together.

Happy trails!!!!

Not quite. It is the Second Anniversary of the GC not the wedding anniversary. You file for ROC within the 90 day window before the GC expires. You will want to keep all items that show your lives are being co-mingled like joint bank accounts, joint tax retruns, lisitng the other as beneficary, wills, powers of attorney, etc. Those things most normal couples do, it is just that you need to keep copies to show the USCIS.

Once you remove the conditions you are a LRP (lawful permenant residence just like now except the GC is valid for 10 years rather than 2). Your responsibilities and limitations on travel and time spent outside the US are the same as they are now.

Good luck and enjoy the next 21 months without having to deal with the USCIS unless you move,

Dave

Quoted for truth - this is very important information so please absorb it. I myself am at the same stage. If there's anything you can think of to bolster your co-mingling and finances (added names on utility bills, maybe drawing up wills, etc) then now is the time to do so. My wife and I are looking to do the latter at some point, and also add me onto the deeds, if possible.

Still, removing conditions is usually a lot less stressful than the AOS itself, so just be vigilant.

Question, do I still need to re-apply for my employment authorization expires? I was issued a 1 year EAD, which expires in April.

Your EAD is void since you received your green card.

First, check the guides and see what type of documentation us required for I-751. Next, get a box or a folder and write on it "ROC stuff". For the next couple of years make sure you update that box/ folder every time you run into a piece of evidence of bona fide relationship ( bank statements, utility bills, lease agreements or House deed, traveling tickets and so on). Believe me, this will help you tremendously rather than waiting 2 years and then struggling to come up with documentation. Other than that, enjoy your life!
