212(a)(3) i - can you be more specific what they are accusing you of? If it is 212(a)(3)(A)(i) (espionage) or 212(a)(3)(E)(i) (member of the Nazi party) then there is no waiver and unless you can prove there was a mix up of identities, no way of getting a student visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

(a) Classes of Aliens Ineligible for Visas or Admission. Aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

Now the 3 part of that reads:

Security and related grounds

Including terrorist activities and espionage.

So what happened in your case? Since such a drastic conclusion was made, if you want help you'll need to explain your case

No waiver, no nothing....of course, like another poster, perhaps you believe that our embassy was 'unfair...'...this refusal code is quite serious, far beyond mere shoplifting (as was the case with the guy from Egypt)...no one at the embassy will grant you a visa under any circumstances, and even if a waiver were available (even if married to a USC), no USCIS adjudicator in his/her right mind would approve one.

Just wondering if there has been a typo, anyway what exactly happened?

Hi, sorry for late reply. The DoS has denied my visa under section 212(a)(3)(A). After talking to layers and people facing with same problem as mine, they are saying my research and academic major has resulted to this denial. Maybe if I change my major and school that will help? because I have been to US once and this nightmare has happened when I wanted to renew my visa after visiting my family... any help and suggestion is appreciated

you are right...I know it is among the most difficult cases to overcome the denial... but there should be a way since as I checked the statistics of the visa types in DoS only very few of the denials under this section are solved...

212(a)(3)(A) are espionage and attempting to overthrow the US government. There are no waivers available.

I don;t think you will ever get a visa to the USA.
